Clarke mother, stepfather indicted in torture of boy

  • Follow Latest News

ATHENS, Ga. -- A Clarke County grand jury has charged a man and woman with 17 felonies for allegedly torturing the woman's son by locking him naked and handcuffed in a closet, shooting him with a pellet gun and subjecting him to other forms of abuse.

Damita Devonna Peak, the victim's mother, was charged with eight counts of aggravated assault, five counts of first-degree child cruelty and four counts of false imprisonment.

The indictment returned Tuesday charges the victim's mother, Damita Devonna Peak, and stepfather, Norris Lazarus Walker, each with eight counts of aggravated assault, five counts of first-degree child cruelty and four counts of false imprisonment.

The state Department of Family and Children Services placed the victim and his younger brother with a foster family after authorities in Oconee County arrested the parents last Dec. 11, a few weeks after they moved from Athens to Bogart.

The Athens Banner-Herald didn't publish Walker and Peak's name last year in order to protect the victim's identity, but this week's indictment shows the boy doesn't have the same last name as either his mother or stepfather.

Authorities opened the case a year ago Friday, when a 6-year-old boy told his teacher in Oconee County that his parents were abusing his brother, then 12. School officials immediately notified authorities, and deputies arrested Walker and Peak that afternoon.

The victim's body, including his genitals, was riddled with more than 100 wounds from pellets fired from a gun at close range, officials said.

Walker and Peak shot him in the closet where, they handcuffed him naked to a clothes bar and left him a pail to use as a toilet, officials said. They also pepper-sprayed him, according to authorities.

Peak briefly was employed as a jailer in Walton County and had handcuffs and pepper spray, said Oconee County Sheriff Scott Berry.

The boy remained locked in the closet for "significant" periods of time, officials said, and when the couple let him out they tied him up in other parts of the house and made him sleep on the kitchen floor.

The boy drew pictures to show investigators how he was abused, including an image of a child facing a wall on his knees, handcuffed and tied, officials said.

The stepfather admitted to investigators that he punished the boy for, among other things, taking a can of corn to eat, according to the sheriff.

An Oconee County grand jury indicted Walker and Peak in February, each on five counts of false imprisonment and child cruelty, and two counts of aggravated assault.

Jurors charged the victim's mother with two additional counts of aggravated assault.

The Clarke County grand jury indicted Walker and Peak for similar crimes, and added that the couple made the victim stand in a corner with his arms extended "for excessive and continuous periods of time."

The couple made the young victim suffer "cruel and excessive physical and emotional pain," according to the indictment.

Peak and Walker moved from Florida to Georgia, but officials are not sure when, or how long, they lived in Athens. Investigators learned they lived in Loganville in June 2006, and that Peak worked as a Walton County jailer for about five months.

Lola this story has nothing

Lola this story has nothing to do with Gitmo or any political party. It has to do with 2 grown adults who should face the death penalty for what they did to that innocent little boy.
Posted by happychimer on Thu Dec 10, 2009 10:14 AM...Happychimer=Hollow Head. No way? I thought this took place in Gitmo and the kid was a republican? Obviously, you do not wish to have a legitimate conversation. I have already condemned the acts of these to low lifes (before you posted this am). I am simply making a point and its obviously one that you do not wish to acknowledge. Wonder why?

We can only hope that the

We can only hope that the charges stick for the two adults, and they are found guilty. And, that the two children are able to understand that not all adults are that way, and it is not their fault at all. God bless the boy and his brother.

Excessive charges may be a
Unpublished

Excessive charges may be a concern in this case with 17 felonies. Is that for two people or only one? An informed citizen would make a relevant comparison and make a decision about the facts. Innocent until proven guilty is somewhere in the rule of law.

Justus, if I write what I

Justus, if I write what I really think about you, I would get banned. You have gone too far. That child- who is BLACK, btw- was tortured. Repeatedly. And read the simple English that the story is written in. It says EACH, as in BOTH OF THEM.
I am asking all of you, each of you that reads this, to express your outrage at Justus' statement.

The death penalty is what

The death penalty is what they deserve, but lethal injection is far too kind a fate for monsters like this. They need to be beaten to death.

Justus(whatever) You have to

Justus(whatever) You have to be really sick to bring in race on this heinous despicable act on these two children. I don't think one poster gave a dam what color they were. These were children that may be destroyed for life by two subhuman POS. If they could only spend the rest of their life's in prison, it would be only a small justice for what they have done. (They may get life, but out in 10)

@Corgimom: you gotta know

@Corgimom: you gotta know that Justus4 makes his statements because he is a sad and angry man who posts his radical views to get your reaction. He will never "get it" and he will never care to change because he enjoys being angry everyday. Just remember he only speaks for a select few who (despite their skin color), find fault in everything. People like this are sad really. We all just shake our heads in wonder.

Leave it to Justnuts to

Leave it to Justnuts to defend these pos. Why not try defending the CHILDREN? "Innocent until proven guilty is somewhere in the rule of law."
Posted by justus4 on Thu Dec 10, 2009 1:37 PM. Not according to your own rantings about U know who. Don't forget that our justice system is broke & they'll be back on the streets with a slap on the wrist, unless they're U know what. BTW 17 felonies are not hard to rack up over time. How many felonies did Walker get convicted on? Something like 157?

Peak is toast as soon as the

Peak is toast as soon as the other inmates find out that he tortured a child AND was a jailer (even if it was for one day). I can hear the inmates now; Inmate 1: "He handcuffed his kid & pepper sprayed him? Wonder how he treated the inmates? Inmate 2 "He doesn't have his handcuffs or pepper spray now & I'm not a kid... It's ON!

No, this isn't about a sad and angry man. This is about an evil man who publically states that the two people who tortured that child has "excessive charges".
