Investigator fails to show in court prompting judge to dimiss case

The criminal case against an Augusta man accused of breaking into the home of an 85-year-old woman and robbing her at gunpoint was dismissed Thursday.

Michael Chad Gribanow, 26, had been held in jail without bond for more than a month. A preliminary hearing was set Thursday in Richmond County Magistrate Court, but when the lead investigator, Ben Harmon, failed to appear to testify, Presiding Judge H. Scott Allen dismissed the charges against Mr. Gribanow.

Mr. Gribanow was arrested in late September on charges of burglary, armed robbery and a weapon violation in connection with a Sept. 9 home invasion, and with burglary in connection with an Aug. 26 break-in on Sycamore Drive. The victim of the home invasion reported her assailant forced his way into her home and held her at gunpoint while demanding money and prescription medication.

The prosecutor can still seek an indictment against Mr. Gribanow.

I would say it is time to

I would say it is time to fire someone for ineffiency. Further, if he was notified to appear in court and didn't show, he needs to be in jail.

If this turkey who failed to appear is an investigator, I am a monkey's uncle. He should be fired immediately. I wonder if the scumbag who robbed the old lady paid off the investigator to pull a disappearing act.

The scumbag who robbed the elderly lady may not be off the hook yet. Many times these dumb magistrate judges will dismiss a case because one witness does not show up. The DA will then present the case to the grand jury who will indict the scumbag. Then more tax dollars will be wasted trying to find the criminal again. Maybe the investigator was in another court or out sick. I'm not excusing him but why couldn't the case be rescheduled or continued at least until the DA finds out why the investigator was not there.

I know for a fact that this

I know for a fact that this Investigator was NEVER served a subpoena. It's funny how the two Magistrates always throw out cases when they are inconvenienced by Law Enforcement, but when their defense attorney buddies don't show, not a peep is said and they simply continue the case. The judge was completely irresponsible in failing to get to the truth of the matter.

I am outraged. How do we get

I am outraged. How do we get a judge de-benched (if that's a word)? EVERY person this scum terrorizes from now on, Judge Scott Allen should be held responsible. I am not believing what I am reading. How can this be allowed? I guess as long as it wasn't the judge's sister/mother/wife... he can just let them go.

He dismissed the case because that's the law. The Constitution says that everyone has the right to face their accuser. And the prosecution must have the investigator in court to testify and be cross-examined. Fair trials, you know? They protect the innocent far more than the guilty gets off the hook. He'll be back, he's not done.

I hope that Sheriff Strength

I hope that Sheriff Strength and investigator Harman scorch the earth underneath the Augusta Chronicles editors feet for allowing this fiction to be printed. This article makes the Richmond County Sheriffs Office elite Violent Crimes Divison look like the Mayberry Police Department. The investigator was not subpoenad to appear in court on this case; thus he not showing up. The blame should be on the Magistrate Court for not checking why the investigator was not present before making a ruling, the Marshalls Office for not serving the investigator with the subpoena in a timely, and the district attorney's office for not having the case continued until all witness are present. AC please get ALL the facts before scaring the general public.
