Jury awards pavers after DOT denied contracts

BRUNSWICK, Ga. - A federal jury has awarded the owners of a defunct Georgia paving company $150 million after finding that the company lost valuable state road contracts because a Marietta laboratory used a flawed method in assessing its work.

Douglas Asphalt Co. of Douglas, Ga., was fired by the Georgia Department of Transportation from a paving job on Interstate 75 in 2004 after the DOT declared asphalt the company had put down on I-75 and in another job on I-95 inferior because it lacked a sufficient proportion of hydrated lime.

DOT depended on testing done by Applied Technical Services Inc. in making the decision to fire the company.

Attorneys representing company owners Joel H. Spivey and his son, Kyle Spivey, argued in a jury trial in U.S. District Court in Brunswick last week that the method used to test the asphalt for its lime content was unreliable.

How can the DOT be faulted in this? I guess they had the biggest pockets.

Wow. I used to work for ATS

Wow. I used to work for ATS but in a different capacity. I'm actually surprised as they are a well respected testing lab.

ISPY the DOT cannot be

ISPY the DOT cannot be faulted as they were relying on info from an accredited company ( ATS ). ATS is to take the hit. More info here:
