Courthouse shooting jury says it's deadlocked

  • Follow Latest News

ATLANTA -- Jurors say they cannot reach a unanimous sentencing decision in the case against a man who killed a judge and three other people in a shooting spree that started in a downtown Atlanta courthouse, but they have been told to try again.

Superior Court Judge James Bodiford ordered the jury to continue deliberating. The split is 9-3. The judge did not ask the jurors which way the majority is leaning. The jury has deliberated for almost 20 hours.

Prosecutors had asked the jury to sentence Brian Nichols to death. If the jury cannot reach a unanimous decision, Georgia law requires the judge to decide whether to sentence the 37-year-old to life in prison with parole eligibility or life in prison without parole.

Nichols was convicted last month of murder and dozens of other counts in the 2005 killings. Nichols was on trial for rape when he grabbed a guard's gun and fatally shot the judge, a court reporter and a sheriff's deputy in the courthouse. He fled and killed a federal agent in an Atlanta neighborhood.

as a black man i find this

as a black man i find this absolutely asinine, this man killed 4 innocent people, this was not a drug deal that went bad or even an accident. this was murder in "COLD BLOOD", i found a link that had the explainations of the 3 bottom feeders who voted against the death penalty, one black female (who BTW owns a .380 handgun) said she voted against the death penalty because "some innocent person could be wrongly executed" an asian man on the jury who voted agaisnt death said he "didn't feel the death penalty is not effective" and wanted proof that it would work. i guess this idiot doesn't realize if nichols is put to death there will be an absolute guarantee he will never kill anyone ever again. the people who voted agaist executing nichols should be financially liable in the event nicols attempts to escape and hurt or kills someone during his attempt, and made to serve his sentence also

They all agree he killed

They all agree he killed them. The system is broken. This should be a decision made by a judge. It's kinda like the recent civil action in Atlanta against TBS. How are 12 citizens going to be able to follow the intricate workings of a $500M deal?

This is exactly why white

This is exactly why white america hates black america and the two will never meet. What does it take for people to see what is plainly in front of their faces, or are they so stupid that they don't know what murder is?

This is way too much- where

This is way too much- where on earth did these people come from. This man killed 4 people and held a woman captive. How hard is it to say - lethal injection asap? I assure you he had not remorse when he was shooting innocent people or when he held a gun to that woman's head! DId these soft-hearted jurors disclose their sentiments toward the death penality when the jury selection was going on? If not, then get them for perjury because every jury I have sat on I have been asked that question in the pre-jury selection.

This is so disgusting until I am literally sick to my stomach. If anyone deserved the death penalty it was this person. You might as well do away with the death penalty because if he does not qualify for it, I cannot see how anyone else could?

The reports say it is the

The reports say it is the Asian and a white that are holding on to no death penalty. Don't know the other hold out. I think the OJ verdict set a bad example of a racist jury gone bad. That's a shame, it set race relations back 100 years

I have never seen so many

I have never seen so many "comment was removed for violation of the comments policy" in one section. Must be some riled up people over this one. Nice to know people are really upset over innocent people being killed for no reason. Too bad they're not serving on that jury.

Why are some folks jumping

Why are some folks jumping off of buildings? The jury cannot decide WHICH SENTENCE to give him and if they do not agree the JUDGE WILL hand down the sentence. HE HAS ALREADY BEEN CONVICTED AND WILL GO TO PRISON. They cannot decide on either life with parole or life without parole. Either way, he won't get out. The judge will give him life without parole.

The death penalty costs about

The death penalty costs about 20million dollars. Maryland says their death penalties cost about 37million dollars each. Endless appeals, which the state pays for defense and prosecution, and maintaining the convict in special facilities costs a lot of money. The jury is split. Why wouldn't they?

I think the death penalty

I think the death penalty should have been decided when the deputy's caught him. KILL HIS ASx. And kill him now. This is why the death penalty is not worth shyt. Back him up and shoot the bastage
