The federal government says not to worry your pretty little head. You can trust old Uncle Sam not to abuse his authority. He'll use the unprecedented, sweeping new power to regulate carbon dioxide emissions, which he just gave himself, judiciously and with common sense.
Feel better?
You shouldn't.
At the same time the Obama administration has moved to regulate C02 and Environmental Protection Agency director Lisa Jackson is saying not to worry, there are documents floating around Washington that strongly suggest Americans should, quite the opposite, distrust their government.
They're called the Declaration of Independence and the Constitution.
It is inarguable after reading those documents that this country was founded largely on a distrust of government.
Yet, consider the Orwellian power the Obama EPA has conferred upon itself this week: regulation of every living organism and every human activity that emits carbon dioxide.
Many are coming to believe that environmental concerns are now being used as a weapon to advance what amounts to a socialist agenda -- worldwide, and even in the United States.
Indeed, a top Obama economic official told Fox News anonymously that EPA regulation of C02 would be used essentially as a gun against the head of Congress to exact global warming legislation favorable to the administration's left-wing point of view.
The official warned that EPA regulation of C02 emissions will be carried out in a heavy-handed "command-and-control way" -- a clear mafia-like message to Congress that "you can pay me now or you can pay me later."
Meanwhile, the Obama administration is at the global warming conference in Copenhagen this week, pledging to unilaterally cut U.S. greenhouse gas emissions by 17 percent by the year 2020, from 2005 levels.
It's possible the ingenuity, innovation and entrepreneurship of the private sector could accomplish that anyway, without government help. But where does the U.S. president, who still operates under the Constitution last time we checked, get the authority to make such a promise on our behalf?
Perhaps from the EPA, in his way of thinking.
Director Jackson says her agency's bloodless seizure of C02 regulation isn't a substitute for congressional action -- only a complement to it.
Does anyone really believe that? Does anyone think that if the Senate turns down the House-passed "cap-and-trade" limits on C02 emissions, that the Obama administration will walk away quietly -- when it has already given itself the power to act without legislation?
What the Obama administration has done this week is simply frightening, and must be challenged politically, certainly, and likely legally.

The Sierra Club brought the suit and the US Supreme Court ruled in 2007 that greenhouse gases are pollutants and subject to regulation under the Clean Air Act. Now EPA has the authority to regulate CO2 emissions and stricter emission rules for cars and trucks are expected to be announced in March. The court ruling may also open the door to civil law suits against CO2 emitters. This is good news and it's a step toward a cleaner world.

I hope the Obama administration allows us to remove him the old fashioned way...by election. His lackeys MUST be removed in 2010. America cannot survive either "cap and trade" or "Obamacare". It's a shame that's it's just now dawning on voters what a horrible mistake was made in Nov., '08, but at least it IS dawning.
it is time for rebillion as our forefathers did. they understood that when a govt controls to much there is no freedom. the way our govt was set up was to have a very limited federal govt and the power was to be in the states. it is time for rebillion because for years and years the political class has been underming our framework of the originial intent of govt. obama crew has just perfected the illegal grab of power. as americans we need to wake up b/4 its too late...
carcraft - I'm not going to pretend to be scientific enough to answer technical questions but the Supreme Court ruled greenhouse gases are pollutants and that decision may be as game changing as their decision on segregated schools. Regulating global warming gases is not without precedent either. Some ten years ago EPA levied regulations on the release of refrigerant gases because they have such a high global warming effect. Those rules change the whole game for air conditioners and refrigeration equipment in this country and now that's behind us and the world goes on.
I think Gas needs to take a look at the way regulations are written and enforved by the bean counters in Federal Admin offices. There is no recourse. If this is the right thing to do, then do it with legislation. We get to elect the Reps, not the bean counters.
robbie - May I say the country didn't desegregate schools with elections nor legislation. The US Supreme Court did it and a lot of people howled about it too!
Hi, Gas. I wasn't speaking about the Supreme Court. I was speaking about the various federal agencies. I may not agree with all of the decissions of the Supreme Court, but it operates within the boundaries of the Constitution. Federal Agencies are part of the Executive Branch and sometimes operate as if they have legslative authority. In some cases, this has worked for the better. Regulations written by the Commerce Dept (and ruled legal by the Court) was one way that businesses were forced to serve minorities. The problem I have with the EPA can write regulations and enforce them at their pleasure and there is no recourse unless we are able to take them to court. I should be clear to state IF we can take the government to court. To do so, we must ask its permission.

robbie - Congress can act and legislate changes to EPA's rules. But Congress is nearly paralyzed by lobbyist and special interest money. Nearly every member has to cater to campaign contributors but everybody denies it's a pay to play game.

The file chronicles the efforts of the programer who "built" the data base for the Climate research unit at East Anglia Unveristy in England, it is 247 pages long, here is one of my favorite quotes, "So with a somewhat cynical shrug, I added the nuclear option_to match every WMO possible, and turn the rest into new stations..in other words what CRU usuallydo. It will allow bad database to go unnoticed and godd data base to become bad.." Also Data from Australia, New Zealand, and Alaska have been modified to show warming when there was actually cooling. The CRU, and Nasa are two of the largest datqa bases on which globull warming is based If the Supreme court ruled based on wrong information the ruling should be modified as in Dred Scott decision, speaking of the Supreme Court!

Gas, If you look at the history of the Federal Admin Depts, you will find very little intrusion by our Congress. That's why the various departments have so much power, and we have no say. The Executive Branch (regardless of who sits in the White House) has used the regulatory power they have given themselves to sidestep the paralyzed Congress. Sometimes it works to our benefit (equal rights), but the potential for abuse is frightening. We both agree that Congress can (but won't) affect any mis-steps by the EPA, so the only way they will be corrected when they overstep is through the courts. I hope I am not on the wrong side of an over-regulation waiting for the Courts or Congress for relief.
gargoyle - However you view it, EPA started regulating refrigerant gases in the 1990's and mandated particular gas types be phased out by certain dates. Also required technician certification to work on refrigerant gas holding equipment and mandated keeping records. A Google search shows the record keeping requirement got tighter in 2009. I read where some states have also enacted similar of corollary refrigerant laws
