Palmer accuser currently on parole

The man accusing Harrisburg activist and Augusta Commission District 1 candidate James "Butch" Palmer of pointing a shotgun at him last week is on parole, having done two stints in state prison over cocaine charges.

Elliot M. Davis, 37, said his past shouldn't matter.

"I'm filing a charge because he pointed a shotgun at me," he said Wednesday. "I could have been a convicted murderer who just got out after 30 years. He still shouldn't point a gun at me."

Mr. Davis told the Richmond County Sheriff's Office that he drove past Mr. Palmer's Tuttle Street home on Sept. 24 with his radio on. He said Mr. Palmer yelled at him from his front porch to turn it down, then pointed a shotgun at him as he passed.

In an interview with The Chronicle , Mr. Davis said he turned around and pulled up in front of Mr. Palmer's house, asking from his driver's seat why Mr. Palmer was aiming a gun at him. He said Mr. Palmer walked to the end of his front walkway, stood behind a gate, pointed the gun at him and said, "Turn that music down, boy, before I shoot you."

Mr. Palmer told the sheriff's office and The Chronicle that he never pointed his Remington 1100 at the man, but only yelled at him to turn the volume down because the bass-heavy music was shaking the windows on his house.

He said Mr. Davis turned around, pulled up out front and started cursing at him. He said he had his shotgun lying on the ground, and feeling threatened, picked it up and went inside, saying, "You're a grown man. You should know better than this."

On Monday, Mr. Davis filed paperwork to pursue a warrant, and a hearing has been scheduled in Magistrate Court at 9 a.m. Nov. 6, three days after the election. Mr. Davis is seeking a charge of pointing a gun at another, a misdemeanor. A judge will decide whether there is probable cause for an arrest.

Mr. Davis said he lives in the 600 block of Eve Street, though not at 609 Eve St., the illegal boardinghouse targeted as a "nuisance" by Mr. Palmer and other demonstrators during their Fourth of July march against absentee landlords. He said he knows some of the soon-to-be-evicted tenants there, though.

According to Georgia Department of Corrections records, in the late 1990s Mr. Davis was convicted of sale and distribution of cocaine and possession of cocaine in Richmond County. Sentenced to 15 years, he was imprisoned from October 1999 to August 2004.

A parole violation landed him back in prison from March 2006 to June 2008, most recently at Autry State Prison in Pelham, Ga.

The state Board of Pardons and Paroles has him in its system as "Larry Jenkins," spokeswoman Scheree Moore said. He'll be on parole until July 2014.

Mr. Davis said he is no longer involved with drugs.

He said he was recently laid off from Macuch Steel Products Inc. and is unemployed.

What about pressing charges against Davis for having a weapon while on parole? He indicated on the news that he had a machine gun in his car, at least that's what I heard. He's a thug.

justus4- You are so funny. Anybody who knows Mr. Davis will tell you he is a thug. He is a troublemaker and a racist. Did I miss anything here? Davis is upset because Palmer wants him and his kind out of the neighborhood. When I say his kind I am referring to drug dealers. Davis hangs out with a bunch of trash staying at the flop house. Davis and his cronies run the streets looking for ways to make a quick buck. They sell drugs, they steal and if you say anything to Davis he is always ready to fight. I do a lot of work in his neighborhood and I am up and down Walton way where I see him often. Instead of standing up for trash like him it’s time to kick his kind out.

Sounds like a he said / he said type of charge with no witnesses. (sort of). Nuisance "citizens" are a fact of life. Palmer could use a little patience, but considering his zeal to raise the quality of life in his neighborhood....

Can I get a witness (other than the two parties involved)! How would Davis/Jenkins know what Palmer said since he was blasting his stereo so loud. If a reliable witness doesn't step forward then we have no viable proof of either story and therefore don't waste the courts time. I agree with Riverman, unless the name was changed legally, the spotlight is going to focus on the accuser.

I don’t know Palmer but I have met him a few times. He is very passionate about cleaning up his neighborhood and won’t be intimidated. He has lived with fear for too long and has had enough of the law arresting and releasing these thugs. The people renting to these know drug dealers should have to be responsible for who they rent to. I screen all my tenants. I feel a responsibility to the neighborhood. If I owned a house by Palmer I’d be happy he is trying to better our land values. Since when does renters get more rights than a owner? When they live in Augusta

lets see....twice convicted felon, who is now unemployed...was sentenced to 15 years the first time only served 5?!?!?!?!?, so why was he sentenced to 15 years in the first place????, then he violates back to prison a 2nd time and just so happens to live in the "600" block on eve street...BUT NOT AT THE ILLEGAL BORADING HOUSE LOCATED AT 609...oh no, not there..so what is mr. davis's actual address????? this is a bunch of crap!!!! i believe it is a set up to attempt to tarnish mr. palmer because he is making an effort to identify and rid his neighborhood of the various hoodrats, thugs and other human debris that has made harrisburg such a dangerous place to live. i have heard both good and bad comments about mr. palmer, but i don't have an opinion either way i respect him for his efforts to clean up the neighborhood where he lives and if i had a chance i would vote for him because of his efforts.

Bite my tongue....bite my tongue.... Ok...I am biting my tongue because I want to shake Justy and Fruitcake til their heads rattle. Oh...I won't do it, don't worry your little minds about it. I can tell you are both BLACK because you are the ones taking sides with A BLACK PERSON whose given a false name and probably a false address who felt it necessary to go by someone's house, not once, not twice, but three times with his music rattling everyone's house. If it were a WHITE felon who had done this very same thing, you both probably would not say a thing. No...wait a minute...maybe you would have because you both seem to have a vendetta against Butch. Actually there are witnesses. The story about Butch's antics was already in the neighborhood Thursday night and over the weekend before the man filed any charges and it was in the news paper. The witnesses are white and friends of Butch.

Wow Fruitbasket, get it right, it was a shotgun, and a twice convicted, unemployed felon making a beer and Kool run drove past his house repeatedly with music blasting in an attempt to provoke something. When he didn't get the response he wanted he fabricated an elaborate tale.. By driving back up to the house he demonstrated that he wanted to provoke a confrontation. I won't call you a racist but I believe your IQ matches up with a GPS figure which would denote the Equator!! Just one or two digits!

Actually I guess no charges were filed against Butch because Elliot M. Davis dosen't exhist. If a person dosen't exhist then what is the problem? Butch didn,t point a weapon at Larry Jenkins because he didn't file a complaint and he dosen,t live on eve street. Case closed. Take down the good old boy network and vote for Butch for anything. I will vote for anything I see his name attached to in the future.
