Man gets life for killing guard in copper theft

A jury deliberated about two hours Thursday before finding Charles M. Tyler guilty of gunning down a security guard to steal a load of copper.

Judge Carl C. Brown Jr. sentenced Mr. Tyler, 27, to the mandatory sentence -- life in prison -- following the jury's decision in Richmond County Superior Court.

Mr. Tyler was convicted of felony murder, armed robbery, burglary and a weapon violation for the June 4, 2008, slaying of 59-year-old David Fulkrod.

Mr. Fulkrod was shot in the face in the doorway of the guard office at CMC Recycling, a place where Mr. Tyler had also worked for a time.

Mr. Fulkrod's possible identification of Mr. Tyler is the reason Mr. Tyler shot him at the start of the crime, Assistant District Attorney Falin Rogers told the jury in her closing argument.

After shooting Mr. Fulkrod, Mr. Tyler drove a 26-foot U-Haul truck to the building where he used one of the business's forklifts to load a 4,000-pound bundle of copper wire into the truck, Ms. Rogers said.

Mr. Tyler rented the U-Haul truck and a storage unit before the robbery, Ms. Rogers said. He also downloaded information from the Internet about forklifts, the weight-bearing capabilities of various U-Haul trucks, and the locations of various recycling centers in the southeast.

But Assistant Public Defender Benjamin Jackson argued to the jury that there was reasonable doubt because other possible suspects existed.

Just because Mr. Tyler had copper doesn't mean he committed the crime, one that the state theorized could have been committed by two men, Mr. Jackson said. Only one person has been charged with the crime.

Mr. Tyler had prior convictions for thefts. Sheriff's investigators suspected he was involved when the U-Haul truck he rented was found with copper debris inside.

Mr. Fulkrod was unarmed when he was shot. He had worked for Sizemore Total Control for 18 years.

He doesn't deserve to live, continue sucking up our tax dollars that could be diverted to help educate our youth or prevent other crimes through public safety. We absolutely must change our system to be much more agressive on violent crime, especially those crimes that involve weapons and certinaly any that result in hurting or killing a victim. Why do we even bother to spend hundreds of thousands of dollars to provide for these individuals when they should NEVER walk our streets again. The death penalty along with how quickly it is implemented, etc. needs to be issued for anyone who kills and once proven guilty beyond a shadow of a doubt (pretty easy now days with technology) then they should be given a week or so to make whatever statements they need to make to their family and if they wish to try to make ammends to God before they are put to death. Stop waisting our time and money on violent criminals.

I agree, Asitisinaug. The problem is that this piece of human excrement, may be back out in seven years. I see no reason why our tax dollars should provide life support to someone who killed a guard over some copper wire. Plus, this was not his first brush with the law.

here we go again, another SCUMBAG lawyer, trying to use every trick in the book to get a murderer off the hook, i wonder how he would have felt if it was his father, brother, uncle, cousin..etc that was shot in face and killed during a robbery....for those saying the defendant desreves a "vigorious defense", i disagree what he deserves is representation while the evidence is presented, then if the evidence proves he is guilty then he needs to be sent to the death house and executed immediately. a vigorious defense should be held for those who are accused falsely and a defense is needed to prove innocence. this trial was nothing more than a waste of taxpayers money

Judge Brown made the right call if the evidence is not conclusive against Tyler. However he should ask to borrow my rope if the case was air tight and without the trial transcripts to review I would err on the side of caution... just in case Tyler isn't the scumbag that pulled the trigger.

I guess the sentence means he will spend at least 5 years in the recreation facility. Keep electing lawyers to represent you and we will keep building palaces, instead of prison camps, for people like this.

I am very happy that the gentleman came forward and called
to report what he had seen that morning of the crime. I truly believe that he should be rewarded for that information . I wonder if the county will step up and do something special for him.
