Officer is arrested on drunken-driving charge

A Richmond County sheriff's investigator cleared earlier this month for his role in a fatal shooting was arrested on drunken-driving charges early Thursday.

Investigator Tim Tobias was in his personal vehicle when he was stopped by deputies on Washington Road, Maj. Ken Autry said Friday.

He has been placed on leave and will go before the sheriff's review board to assess his job status.

In November, Investigator Tobias shot and killed Joseph Gooden Jr., 26, after he robbed the Captain D's restaurant on Wrightsboro Road. District Attorney Ashley Wright did not pursue a criminal case, citing "no evidence whatsoever of criminal intent."

A marshal working security at the building recognized Mr. Brinson and recalled he had been fired earlier this year, Sgt. Chew said.

Mr. Brinson remained at the Richmond County jail Friday night.

Sucks to hear about Tobias getting a DUI. We all say that we wouldn't drink and drive but that's when we have sound judgement. I got stopped years ago for DUI. When I started home I felt completely fine. I just hope the shooting wasn't the reason for Tobias' drinking...but something like that has to weigh heavy on a person.

patriciathomas

Dang, was the shooting incident even remotely related to the drunk driving incident, beyond occurring to the same person? The implications of this little article seem to be mighty damning.

patriciathomas

A lot of people confuse guards with officers.

Reality

Just because you get charged with DUI, it doesn't mean you are too impaired to drive safely. I am not condoning getting drunk and trying to drive. There are many people who sit high on their pedestal..........

NEone

Reality: If he was pulled over, he must have been doing something to raise the officer's suspicions. I would doubt that he was "driving safely".

Reality

Who knows, maybe his break light was blown out. The first thing they ask you now after being pulled over for anything is, "have you been drinking?"....

My_2nd

get some help Tim.

overburdened_taxpayer

Tobias payed the second most ultimate price in protecting the citizens of this area, that of having to take a life. It has never happened to me as a deputy, thank God. That shooting could be related to his drinking, we just don't know. If that is the case, it is not excusable but it certainly is understandable. Whether it is or isn't, I hope he gets the help he obviouly needs and that his service to this community is considered while dealing with this situation. Good people make bad choices every day, whether they are peace officers or anyone else and a single incident like this should not become the definition of who they are.

Reality - DUI is being too impaired to drive safely. get a clue!

wildman

Overburdened taxpayer, I agree. Taking a life would take me awhile to get over.

petersteelmore

2nd, get a clue, reality is right--he could have been pulled over for any number of reasons besides driving in an unsafe manner.

petersteelmore

Totally agree with PTs assessment, what does one thing have to do with the other???

jaschild

if it were a consequence of the shooting... i believe it is common for the deputies to go through some counseling to deal with the circumstances ...and the resulting trauma. i'm surprised that this made the paper and was not swept under the rug as the badge usually gives them "pristine" privileges. undoubtedly his driving was erratic or he has some enemies.

My_2nd

petersteelmore - you get a clue moron. it does not matter why he was stopped. to get charged with DUI the officer must prove you were too impaired to operate the vehicle safely. anymore stupid comments. did i mention GET A CLUE.

prolifer

The stop must have become confrontational. Whether he shot and killed a man or not had nothing to do with getting in a vehicle and possibly taking a life. We all have issues. That does not excuse drinking and driving. If you or I lost a loved one in a tragic accident where we survived and watched them die, believe me, when caught drinking and driving, we'd go straight to jail.

DEVGRU

There should be a program for officers to attend if they have to take a life in the line of duty? Is there? If you don't know about the workings of the human mind don't make judgments. Killing someone and drinking can be a related issue.

ListenAndLearn

I hope & pray that everyone on here who spouts "one has nothing to do with the other" never have to take a life. The article doesn't say whether he went to jail, but I'm pretty sure he did, since he was "pristinely" arrested. That's where they do the Intox test. All the article said was that he was put on leave by the department. AC journalism is sketchy at best. I can't speak about RC, but most Depts have some sort of counselling program in place. There's as many DUI's caught for "other stuff", brake light, checkpoint, etc. as there are for erratic driving. As for enemies, I don't think most of his wear a badge.
