Man is sentenced for robbing elderly woman

A man who broke into the home of a 94-year-old woman on Aug. 8, pushing her to the floor and robbing her, pleaded guilty Monday.

Cheyenne Gaines was to stand trial in Richmond County Superior Court. He instead pleaded guilty to burglary and obstruction of an officer. He was sentenced to 15 years in prison.

Lawyer jailed for her repeated absences

An Augusta lawyer was sent to jail Monday for repeated failures to appear in court.

Superior Court Judge Michael Annis found defense attorney Cara Rowe in contempt of court for not appearing at a Monday morning call of the trial calendar in Columbia County.

At a contempt hearing Monday afternoon, Judge Annis sentenced Ms. Rowe to pay a $200 fine within 30 days or serve 10 days in jail.

When Ms. Rowe chose to serve the 10 days, she was taken into custody and transported to the Columbia County Detention Center.

Judge Annis said he could not comment on the matter.

According to the jail, Ms. Rowe was released Monday evening after paying the $200 fine.

X-Mart's legal attack limited by new ruling

The businessmen trying to open Augusta's only adult video store can't add a new line of legal attack, the federal magistrate judge has ruled.

Augusta Video, the owner of X-Mart Adult Supercenter, has been trying to open a store on Gordon Highway since 2002 but has been blocked by city leaders.

Last year, the 11th Circuit Court of Appeals ruled the city could not keep the business closed by changing its zoning ordinances.

The case then returned to U.S. District Court in Augusta, where Judge Dudley H. Bowen Jr. allowed attorneys more time to continue the discovery process as it applied to X-Mart's compliance with setback requirements that restrict an adult business' proximity to schools and other public places.

X-Mart's attorneys also wanted to ask city employees about existing adult businesses and their conformance with city ordinances.

U.S. District Court Judge W. Leon Barfield ruled Thursday that the issue was outside the scope of what Judge Bowen allowed.

Police searching for Aiken man's shooter

An Aiken man was shot Monday afternoon near Richland Avenue and Sumter Street, according to Aiken Public Safety.

The unidentified man was shot in the hands and chest with a shotgun.

He ran to a house on Kershaw Street, called 911 and was taken to Medical College of Georgia Hospital.

Police were searching for a two-door, silver car, possibly a Ford Mustang.

Inmate's suit shouldn't be blocked, court says

An inmate at Augusta State Medical Prison was entitled to his day in court, a federal appeals court has ruled.

It was wrong of the U.S. District Court to bar Robert Heard from filing any new lawsuit until he paid off court fees from other cases.

Mr. Heard had filed at least 17 cases in the Southern District of Georgia since 1990.

The 11th U.S. Circuit Court of Appeals reversed the case, writing that the judge should have at least considered whether Mr. Heard was in danger of physical harm.

Mr. Heard wanted to sue the prison and two physicians for allegedly administering injections that caused painful swelling of his joints and knees.

re-open. the store owners

re-open. the store owners have been trying to re-open the store since 2002. I honestly don't understand commissioner's arguments here. "business gateway to augusta" as reasoning for changing ordinances right under a business owner's feet. I'm sorry, but perhaps they should be more concerned with the hotels on Gordon Highway that have a less than salubrious reputation. Besides, I'm tired of MAE's having a lock on videos and the outrageous prices they charge.

I dont see what the big deal

I dont see what the big deal is with having X-Mart there. But on Washington Rd you have Lucy Love which is also an adult store, and its located on one of the busiest streets in Augusta. Go figure huh!!!
