Mistrial declared in fatal wreck

A Columbia County jury could not reach a verdict Saturday in the vehicular homicide trial of a Harlem man, prompting Judge Carl C. Brown Jr. to declare a mistrial and send them home.

It will be up to the district attorney to decide whether to retry Brandon Christopher Newman, 26, who had been charged with two counts of vehicular homicide in a May 2007 accident that killed his brother and a female passenger.

"I hope this ends it and lets these families begin the healing process," Mr. Newman's attorney Vic Hawk said afterward.

The Superior Court trial lasted most of the week, and the 12-person jury deliberated five hours Friday and 31/2 hours Saturday before telling the judge they were sharply divided on verdicts for several of the charges.

Police said Mr. Newman was driving his truck on Harlem-Grovetown Road with his brother Cameron, 23; Mallory Jason, 19; and Sarah Boykin, 16, when he lost control and struck a tree.

The crash killed his brother and Ms. Jason and injured Ms. Boykin.

Mr. Newman was accused of racing with a friend before entering the sharp curve where the wreck occurred.

He was also charged with serious injury by vehicle, driving under the influence of alcohol and several other charges.

During the trial, his defense contended Mr. Newman lost control of the truck after he was bumped from behind a vehicle driven by a friend. His attorney also maintained Mr. Newman was not under the influence of alcohol at the time of the accident.

No Mr. Hawk this should not end it. There has to be accountability for the deaths and injuries resulting from this "accident " for lack of a better word.

I guess this is what happens when you pay for a over priced lawyer. Justice has not been served. The D.A. needs to bring this back to trial. I know it will be hard on the families that have lost loved ones. They need to move the trial to a different location out of the area. Then make Mr. Newman pay back the cost of the new trial. This so called MAN has to pay for what he did. Since he will never admit that he is guilty to anything. He has destroyed too many lives to be given a slap on the wrist.

What does a high priced lawyer have to do with the decision of a jury? I pretty sure he's learned his lesson after killing his brother and friend. Why do people make it sound like he's smiling and ready to go have a drink and kill people. Haven't all of us done some stupid things? I'm also pretty sure his friends knew he was drunk and laughing having a good time when they were in the car racing or whatever it was.

I will tell you why, He killed 2 people, he is still drinking and driving- a fact, He was seen laughing and carrying on with his family at the trial, He has absolutely no remorse. Unfortunately, the lawyer got a guilty man off by playing on the sympathy of a couple of dumb[filtered word] in the jury. If not put in jail and made to pay for his crimes, we will see him in the paper again. Quit trying to play this off as if the victims of this terrible trajedy are guilty as he is, 2 of them were underage. Your attitude( I am sure you are one of his friends he parties with, is the reason noone believes he has any remorse.

How could a jury not find this man guilty. Realizing that he lost a brother and hopefully suffers some pain from that loss, he also killed the 16 year old girl and should receive punishment for her death. It is unimaginable with the amount of evidence that the jury could not find him guilty. He should not be allowed to drive or drink and should serve some jail time.

driving by the spot of that particular accident scene it hurts me to know that he is getting off pretty much free. i agree he needs to be punished, but not necessarily the death penalty. he killed his brother and a girl who he was close to after making a bad decision. being in ems i understand the pain of working these wrecks, and i know for a fact this one affected many in the ems/fire/police scene. i just dont see how he can just be let go like that. so hopefully he stays in jail until his trial is to start again.

Edst4, I agree. It is absolutely horrible that our court system allows lies, falsehoods and make believe stories into the jury deliberations. He did it and if he is not punished with some jail time and a big dose of remorse, ackowledgement and manning up, someone else's family member will die at his hand. A little known fact, one of his "friends", maybe one of the outspoken ones in his defense, actually stole credit cards from the deceased girls wallet after her death, bought clothes, alcolhol and whatever and left the bills for the family. Luckily she was caught and punished for her crimes. This kind of character witness probably can't be entered into the court proceedings but don't that speak volumes for the people he hangs with. I hope he gets another trial and does some time, for the next victims sake.

This story has hit home with me. I am not sure of, or will not pretend I know the circumstances surrounding this young man's trial. All I know is, and this is speaking from experience, that there were probably adults other than this young man involved in this horrible incident. Obviously, the lack of due diligent investigation into the cause of this accident was less than par. If the DA's office was unable to prosecute this case then it reflects the lack of evidence which divided this jury. The law is cut and dry and feelings are not. As a mother who lost a child in an accident I immediately relate to those who lost their children, and to a lesser extent, maybe, to the young woman who survived with "serious injuries". To watch your child fight for their life and then succumb to their injuries is equally heartbreaking. I pray for all those who were involved, but leave you all with this thought, the needed evidence through lack of thorough investigation has led to the outcome of this trial.

Wow, the comments on this article are too personal. I'm sure that Newman hurts everyday that his actions led to two people's deaths; especially that of his brother. I lost a brother to a car accident in 2004. It was by far the worst thing that has happened in my life and it fundamentally changed the fabric of my family. Honestly, it changed my entire life. To say that ANYONE would be sitting around a court room with no remorse that he accidentally killed his brother is the most ignorant statement I've ever read on a Chronicle comment board (and that is saying something). So, honestly, unless you are there in the courtroom or were there when it happened, don't assume that you should be considered some authority on the subject. It seems to me more like some of you are a degree or so removed from the situation and are really enjoying keeping the rumor mill going instead of helping people begin healing. No matter who is at fault, everyone here needs help healing, trust me. Be productive.

There is no doubt that these families lives will never be the same. What we all need to do is fall on our face and pray for everyone thats lifes have been changed due to this accident. There will never be a day that passes where tears won't be shead. God is the only one that can bring peace and comfort. I know people from both sides of the families. I choose not to judge but to pray for them. This could have been my son that died. PLEASE PRAY FOR GOD TO BE IN CONTROL OF THE DECISON TO BE MADE NOT MAN.

My daughter hung around her for just a short period of time against my better wishes but figured her out real fast and quit hanging around her. It was when she was hanging around that girl that she met Brandon Newman and she said that boy and that whole group was wild. I can not believe the jury let this guy get off. I guess like Shadow said, money talks. I don't see how Hawk sleeps at night knowing he lets scum like this walk or drive the streets. I pray they retry this case and the next set of jurors don't buy in to Hawks BS

People! He did not kill anyone. There was a car accident and two people DIED. There is a difference. They were all in the vehicle that night, Brandon just happen to be driving. Anyone of them could have been behind the wheel that night. He loved both that died that night, he suffers. We all do. It is all very very sad. You all should be ashamed of yourself. Yes there was a car accident termiller due to negligence and stupidity on Brandon Newman's part!!! He was speeding on that road and had been drinking and doing whatever else and took 2 lives one being his own brothers. And he is STILL drinking and doing whatever else. So I don't think he has learned anything about what drinking and doing drugs can do to you while driving. He should do his time!!!!

Wow! I'm literally speechless reading all of these comments. I didn't know any of the Newmans, but knew other families involved with this terrible accident and this trial has been difficult enough for all. Especially having to see pictures of the crime scene and autopsy photos. Everyone just wants this chapter over once and for all. Everyone involved has to carry that night with them forever as it is. True, brandon should receive punishment of some form, but he will get his one way or the other. It always works out that way. And as for the one who claims that "that whole group is trash", HOW DARE YOU!!! Yes, there are/were some in that group who were living life way too fast for their ages and participating in things that they shouldn't, but to call the whole group trash is uncalled for. Some of those boys and girls had a huge wake up call that night and have turned their lives around for the better and I couldn't be more prouder of them. They say it sucks that losing and almost losing a great friend took that, but they know that Mallory and Cameron would be proud of them for making those positive changes in their life.
