Deliberations to begin in 2007 fatal wreck

A Harlem man charged with two counts of vehicular homicide in a May 2007 fatal wreck took the stand Thursday.

When cross examined by Assistant District Attorney Adam King, Brandon Christopher Newman, 26, said he had two liquor drinks before a party in Hephzibah and drank two beers there. According to a toxicology report, he also had traces of marijuana in his blood.

Mr. Newman was driving in foggy and damp conditions on Harlem-Grovetown Road during the early hours of May 13 with his brother, Cameron Newman, 23, of Harlem, Mallory Jason, 19, of Martinez, and Sarah Boykin, 16, of Richmond County, when he lost control of his Dodge Quad Cab truck and hit a pine tree, police said.

"It's not fair for everyone involved," Mr. Newman said from the stand. "Everyone's lost (something)."

Mr. Newman has been accused of racing with a friend before entering a sharp curve in the road, where the crash occurred. The one-vehicle wreck killed Cameron Newman and Ms. Jason, and injured Ms. Boykin.

Mr. Newman is also charged with serious injury by vehicle, driving under the influence of alcohol, driving with excessive blood concentration, reckless driving and an open container violation.

The defense claims Mr. Newman lost control of his vehicle after he was bumped from behind by a 1991 Chevrolet Blazer driven by a friend. Though Mr. Newman said he never felt his vehicle bumped, his defense attorney, Victor Hawk, said a slight bump is enough to lose control.

Mr. Hawk said Mr. Newman was not under the influence of alcohol at the time of the wreck. "A person can ingest alcohol and not be impaired at all," he said.

Jurors will return to court at 11 a.m. today to begin deliberations.

Yes the winner will be the tax payers that have to pay for this idiot to sit his [filtered word] in prison. He remembered that he was bumped from the rear by another driver. As drunk as he was whatever!!!! Also anybody that drives Harlem Grovetown road knows that you can not do anything stupid on that road like race. Once again an idiot. On that note, I say but him in a car strap him in nice and tight. But a brick on the gas pedal. Put the car in drive and let him hit that same pine tree head on. At least he will be sober and be able to see and feel what it is like to hit that tree. The last thing he sees before the devil takes him.

Mr. Hawk is right. I have never had any kind of alcohol in my life. However I know that a person could have a drink and not be impaired. That is why the level is placed at .08 and not .01. Having said that, I doubt that in this case the driving was not impaired.

edst4-he was in the truck when he hit the tree. He was the driver. Yes everyone lost something. He lost his best friend, his brother. He has to live with this everyday of his life. Those two were best friends and did everything together. He is in no way an idiot and yes he was being raced by another who lives down the road. The only person the devil needs to take is your evil tongue. Only God has the right to make that judgement and you are not GOD! No one told those girls to get into the truck, drink or attend this party. Their parents have to hold blame also. He has to pay his bills and does not have "free" lawyer service. The tax payers do not support him. He works and lives with his father. He has never asked for a hand out. I guess you NEVER made a mistake when you were younger. Shelby69, when i turned 18 the legal drinking age was 18. So no i never drank when i was under age thank you. Also the only thing I have done to have caused me to stand in front of a judge was disorderly conduct, I say back in 1979. Yes I was sober when arrested. Am I god no where close to it. Never said I was you did. He has to pay for his crime by working well so be it. I said when he is sitting in prison not jail. It is MY and everybodys tax dollars to have him sit there do nothing get 3 meals a day free dental free health. As far as being an IDIOT by racing and he knew he was racing on Harlem Grovetown road. You really dont do that if you are sober, nobody in there right mind would race Harlem Grovetown being sober. Plus he had a trace of drugs in his sytem. Lets see drunk and drugs. Yep they go hand in hand. Plus he was 25 when this happened. Ok lets see at the age of 25 you should have some common sense by then.

I agree with you Shelby69. This is truly a sad situation and I'm sure Brandon will live with his mistake the rest of his life, every time he thinks about his brother and friend. Although Brandon should be responsible for his conduct, edst4, your form of justice is way beyond cruel. We have trials not just to determine if someone is guilty or innocent but so that all the circumstances relating to the case can be heard in order to determine how severe the punishment should be. Edst4 you're complaining about tax payers paying for his stay in prision (if that is the judgement)...what's the alternatives....let him off on probation or lets just take him out and shoot him. If the latter is your opinion then you have no compassion in your heart.

I just can't believe Victor Hawk would stoop so low with some of his statements. My daughter knew this boy a few years back and she stayed away from him and those he hung around with because they partied a little too heavy for her likes. I doubt very seriously that he just happened to be in a room where someone was smoking pot. I am sure he has allot of guilt especially knowing he killed his brother. He definitely should do the time for what he did and yes, he should be made to talk to high school students and explain what can happen when you drink and do drugs and get behind the wheel. I do agree with edst4 in that he should have plead guilty. he knew he had drank and still got behind the wheel jeapardizing everyone in the vehicle, and no they did not have to get in it knowing he had been drinking but you have a certain trust factor I guess with your friends and hope they are making sound decisions and aren't going to be racing down any road especially a road like Harlem Grovetown Road. But he wasted taxpayers money, people's time and dragged the families of the deceased through this nightmare AGAIN. Let these families have closure and do your time!!!

Drunk driving is inexcusable and reckless when you're driving alone. This case is an example of what can happen when you drive drunk and recklessly with passengers. The driver is responsible for taking irresponsible chances under high risk driving conditions. His decision making abilities seem to be severely stunted and underdeveloped.

We forgive you for killing our child or our family member. I dont think you would. What would have happened if he hit a car head on and killed a family of four? It all points to what I said. If by some chance somebody did that to a member of my family. I would pay somebody in prison to make the problem quietly go away. How does the saying go? An eye for an eye, a tooth for a tooth. "Meaning the notion that for every wrong done there should be a compensating measure of justice". Also for the bible welding folks it can be found in this passage. Instead of pointing out the obvious fact that Brandon will serve time for the accident, everyone needs to realize that 3 families were affected by this and it changed lives forever. Cameron and Mallory lost their lives and Sarah had terrible injuries. Their families need love and support, not the terrible things that are being posted.

i agree with an eye for an eye, when it is truly deserved. there was an artilce the other day where a sister pleaded with the judge not to put the person to death that killed her sister. that was mighty big of her and i respect her. the blame only seems to be placed on brandon. that is not fair. he did not mean for this to happen. he was bumped from behind that is why the other guys car disappeared so fast following the accident. not only are the "poor girls" being drug thru this, but what about the newman family? are they not affected by this trial as well as the "poor girls"?

The passangers and thier families are the ones paying for this young man's MISTAKE. What is he pleding not gulity to?? Drinking, driving the truck, or his reckless disreguard for his family & friends lives? Shelby that BS about being bumped from behind was something Hawk thought up. Brandon himself said he did not feel the blazer bump him and the driver of the blazer said he did not bump him. Hawk is grasping for straws. This is a terrible trajedy but Brandon needs to take his medicine so to speak.
