Hospital worker steps down after sexual battery charge

Police in Millen, Ga., arrested a Jenkins County Hospital official Friday and charged him with sexual battery.

James Alvin Burke, 55, of Lynda Drive in Millen, was charged with misdemeanor sexual battery, according to a jail official at the Jenkins County Sheriff's Office, where he was booked about 10:30 a.m. Mr. Burke bonded out of jail about an hour later with a $1,000 property bond, the jailer said.

Police Chief Dwayne Herrington said the case was under investigation and that he could not release details until possibly next week.

"We just don't want to make any mistakes," he said.

Pete Mills, the hospital's chief executive officer, confirmed Friday afternoon that Mr. Burke resigned as hospital administrator, effective Thursday.

Mr. Mills said he was limited in what he could say, but he did reveal the incident involved a female employee.

Mr. Burke was second-in-command at the 25-bed, critical access hospital, where he worked for at least 10 years, Mr. Mills said.

Sexual battery.

(1) A person is guilty of sexual battery if he or she engages in sexual penetration with:

(a) Another person without his or her consent;

(b) A mentally defective, mentally incapacitated or physically helpless person; or

(c) A child under the age of fourteen (14) years.

(2) A person is guilty of sexual battery if he or she engages in sexual penetration with a child of fourteen (14) but less than eighteen (18) years if the person is in a position of trust or authority over the child including without limitation the child's teacher, counselor, physician, psychiatrist, psychologist, minister, priest, physical therapist, chiropractor, legal guardian, parent, stepparent, aunt, uncle, scout leader or coach.

Sexual battery also includes those incidents that involve others older than 18, but do not give consent. If you read the article, it stated that the victim is an employee at that hospital, and is obviously older than 18. At least the man had the decency to step down from his position of authority. Now let a jury decide what did, or did not happen.

This is a matter of a non-intentional, misplaced hand on the lower back (no lower than the belt line!!) of a "female" (woman is an overstatement) who decided this was her chance to get rich, by defacing a respected mans character. I hope all comes clear in court, and this female is charged with false accusations.

Kat30815, This "male" (not a man at all!!) has admitted what he did and it is much more than you state. This woman just wants to be protected and to protect others. Do you know her? How many more might there be? No one in authority should ever touch another and especially not inside their clothes!

What leads you to believe he has made any admissions to guilt? A resignation does not automatically mean a person is guilty. I believe both parties should have been put on administrative leave while this is being investigated. However it is Millen. Their sheriffs office would investigate the death of a squirrel just to keep entertained.

What makes you believe that you know ANYTHING about this particular case? He HAS admitted his guilt. If he has suddenly changed his story, then he will have a great deal of explaining to do to overcome the evidence. Your low opinion of the town of Millen and "their" sheriff's office shows that you are on the outside of the community and obviously know very little about the situation. Speaking out without knowing the facts makes you look foolish.

Anyone with any knowledge of the criminal justice system knows that an allegation does not warrant an arrest. After an allegation is made the law enforcement agency with jurisdiction begins an investigation. Once the investigation is complete, a judge must then issue an arrest warrant. If you bother to read the article published in both the Chronicle and The Millen News, there should be no question as to whether the accused was arrested or not. After the allegation, investigation and arrest the accuser (victim) has nothing do with the case. It is then in the hands of the judicial system. For example....the state of Georgia, the county of Jenkins, etc. VS the accused person's name. As for the people of Millen, of course they will gossip and choose sides, etc, that is a way of life there. If you will go back and remember what your mother taught you as a child...it will serve you well. The truth should always be told, it will set you free and if you don't have anything nice to say...don't say anything at all! May God have mercy on us all, as undeserving as we may be! Also you might need to remember that all humans are sinners, the Bible tells us that we are sinful by nature.
