Aiken officials ban smoking indoors

AIKEN --- The Aiken City Council has passed on first reading an ordinance banning smoking in indoor public places, including bars and restaurants.

Not everyone who attended the meeting Monday night was in favor of the ordinance.

"I think we have a fair ordinance," said Sam Erb, the owner of The West Side Bowery. "But my concern is if this is passed today, we now have a stronger ordinance than the county."

Last June, the Aiken County Council passed a smoking ban ordinance that did not ban smoking in bars and is enforceable only in the unincorporated areas of the county.

Mr. Erb told the council there was a concern that banning smoking in bars would drive customers away.

"I feel that at least in the downtown we have very responsible business owners," said Mr. Erb, whose business has been smoke-free for 16 years and features an outdoor area where smokers can light up.

The smoking ban excludes enclosed areas that are at least 50 percent exposed to the outdoors.

But others felt the ban didn't go far enough.

Don Swindler, who suffers from asthma, told the council that the smoking ban ought to be expanded to include outdoor public areas, such as at the O'Dell Weeks Center and Citizen's Park.

"We know how important it is to get the smoking out of the buildings," Mayor Fred Cavanaugh responded. "But when you talk about the outside, people have to have the right to smoke outdoors."

Jane Page Thompson, a local realtor, argued that because Aiken's bar culture is growing, banning smoking in those establishments would be fiscally irresponsible.

"I don't want to see us lose that youthful vitality we have by eliminating this from bars," Ms. Thompson said, urging the council to give businesses a choice. "People can choose not to smoke. I think it's fiscally irresponsible not to do a feasibility study on how it will impact businesses."

Councilman Don Wells said he would vote for the ordinance, but he didn't like the thought that "they were hammering away at people's rights."

The council will hold a second reading and public hearing on July 14.

IN NORTH AUGUSTA


A second hearing on a proposed ordinance banning smoking in indoor and outdoor public facilities in North Augusta drew a crowd of bingo patrons seeking an exception.


About 45 players from Shamrock Bingo filled North Augusta City Council chambers for an amendment for a smoking room with separate HVAC.


Motions were made by council member Ken McDowell that would have accommodated the facility but ultimately failed on a 5-2 vote.


Mayor Lark Jones said he didn't want to make amend-ments for just one facility.


An amendment defining an outdoor area for smokers passed 6-1. Arthur Shealy was the dissenting vote.


Council will take up the third reading of the ordinance at the July 7 meeting. It would allow smoking within 10-feet of the entrance of a public facility.

Swindler just needs to never go outside for petes sake. Can't you people compromise on anything? No smoking outside because of your asthma. You want to cut down all the tress and flowers that may mess with your asthma outside? How bout lets just park every vehicle in the world to accomodate you so the exhaust won't bother you!! If your asthma is that bad that someone smoking in the great wide open world bothers you and you can't just walk away, tuff.. stay inside. There are a million other things outdoors that can interfere with your asthma!! As far as the bars and stuff go, don't want to frequent a smoking establishment... don't go.. just like if you don't like the music played there... don't go. The rights of the patrons should be second in my opinion and the rights of the owner to allow it or not should be the answer. Come in drink like a fish then go drive yourself home... but please please don't light up next to me in a bar and disrupt my choice to destroy my liver then drive home on the same road as your family. IDIOTS. This costs bars money, I hope the ban is like the one here, as long as no one under 18 is allowed in, people can smoke. Should be owners choice, then the patrons to decide if they want to be there. I can appreciate the health aspect of what people are trying to do to discourage smoking and agree especially indoors with children, but for petes sake you could save more lives if people put as much energy into stopping drunk drivers than stopping people from lighting up. If you don't want to be around a smoker you can move and get away from the smoke.. or leave. You can't get away from the drunk driver that sneaks up on you and takes out a whole family in one swoop!!! God forbid we take the time to try to punish or stop more drunk drivers, it would take to much time away from trying to ban smokers in a bar!!!!!! Priorities are screwed up!! And to not let an establishment have a seperate smoking room with seperate hvac is ridiculous. Compromise and priorities people!!!!!!!!!! Idiots!!

Richmond County has this law and it has NOT caused any loss of income by businesses. I believe it has been reported that business has increased. Takeastand no doubt is a smoker-tuff, suck it up and don't be spewing your poison where I have to inhale it. I wnt to know when the N Augusta council is goiing to get the gonads to do the same.

jack, if you read my post I agree indoors especially where children are it should be banned, but if outdoors you can't move away... then tuff!! And children should not be in bars anyway, if they are, you suck as a parent. And Individual bar owners should have the right to have a smoking room with seperate hvac or have a smoking establishment. Some people open smoking lounges, what is the difference. If I want to open a small smoking pool hall, it should be my right!! Sorry if you did not suceed in reading comprehension, but try again, I agreed you shouldnt be forced everywhere to inhale it, but outdoors and in your own car??? or if an owner wished to open a smoking bar it is not right to stop him. But looks like you like everyone else care more about stopping a smoker in a bar than a drunk driver leaving it as I stated earlier, which you didn't even address before spewing your crap. Did you even read my whole post, that's what over half was about? Priorities. You don't have to agree with me, but understand what you read before getting you panties in a wad. TakeAstand, I agree with you 100%. We do have "documented" proof of drunk drivers actually killing or crippling others on our public roads. Not to mention all the shooting, stabbing, sexual assults, brawls, peeing on the streets, vulgarness, just for example, etc.... that often happen when someone is drunk or just drinking! I wonder what "documented" proof we have of someone actually dying from second hand smoke only and when was the last time someone was beaten, stabbed or shot or any of the above mentioned things because of the mental state of a cigarette smoker? Priority is correct and I think we should also add in prospective as well. This is also way to much government control and people should realize this before it is to late.......

I did not know Aiken County had an ordinance. I thought restaurants in North Augusta still had smoking sections. Isn't the NA city limits considered incorporated?

Tyvm Doe. I wish more people would speak out about it, maybe something would get done. But most people just ignore it. And yeah imdstuff it's something like that, not sure of the details. Like one sells beer on sundays one don't too I think. Last I heard anyway. lol

I absolutely hate cigarette smoke, and the smell it imparts on my clothes. Yuck!! Still, I agree with TakeAstand... if it bothers me, I simply move away. Outdoors I do the same. Unless it's an illegal drug, owners should not be told by the government to ban smoking in their establishment. Period.

And Doe, cancer and death by second-hand smoke is a well-documented issue, else it wouldn't be an issue.
