ATLANTA --- The State Elections Board is firing back at the Georgia Democratic Party's renewed attempt to defeat the state's voter ID law.
The board served notice with the court that it considers frivolous a lawsuit the Democratic Party filed three weeks ago to block the voter ID law from being used in July's election.
If the lawsuit is ruled frivolous, the state could recoup fees and expenses for fighting the challenge. The board voted 4-0 to file the notice. Member David Worley, the lone Democrat, was absent and did not vote.
The lawsuit, filed after the U.S. Supreme Court upheld Indiana's voter ID law, is frivolous because challenges to voter ID laws in the Georgia Supreme Court, U.S. District Court and U.S. Supreme Court all have failed, said Matt Carrothers, the spokesman for Secretary of State Karen Handel, who heads the board.
Jason Carter, an attorney representing the Democratic Party in the lawsuit, noted that two judges have already ruled in favor of the similar issues in a previous lawsuit.
