Harbin's court date for DUI arrest is delayed

ATLANTA --- State Rep. Ben Harbin's day in court for a drunken-driving arrest in Atlanta was postponed again Tuesday at the joint request of his lawyer and the city's prosecutor.

The new date is June 24. The delay will allow more time for negotiating a plea bargain, but the lawyers cited other reasons.

Mr. Harbin, R-Evans, was charged with driving under the influence after his car struck a telephone pole at 2 a.m. on an Atlanta street about a mile from the Capitol.

The trial already had been postponed more than once at the request of attorneys for both Mr. Harbin and the city. Then it was delayed until after the latest legislative session because state law protects legislators from prosecution while they are required to represent their constituents.

Tuesday, Assistant City Solicitor Warren Atkinson, who will prosecute the case, told Judge Herman Sloan that he needed more time.

"I just received the case. I will need some time to digest the case," Mr. Atkinson said.

Sorry, PT, it looks like Harbin's supporters, the ones who give lots of money, are not concerned with his behavior. They are concerned with the favors Harbin can grant from the appropriations committee. Campaign money is rolling in for Harbin in spite of the scandals.

Harbin is the Harbinger of utmost stupidity. As I stated yesterday, please get your stupid drunk butt in court and face your consequences (which may not be any.) His "lawyer" and Harbin are hoping to delay as long as possible so if the arresting officers(s) are gone, or evidence "disappears" it's an automatic dropped case. This DUMB-SHxx should be put in public stocks to be flogged as a menace to society and a detriment to moral standing. The biggest TURD in government! FLUSH him like the TURD he is!

GA's (state) government is part-time. They are only in Session 40 days every year, starting the 2nd Monday in January. The law was passed to protect legislators from being arrested and basically being held hostage for demands from local officials during the time they pass laws. Why do you think we only pay them $17,000 a year? Could you work for that and support your family? Yet we expect them to be available any time we call and pick on them when they don't show up for every official function, breakfast, lunch or dinner. We expect them and their families to be perfect all the time, no human mistakes allowed. We feel we have the right on comment on every aspect of their lives. You couldn't pay me to run for office!

That is really hypocritical! Under our current judicial system, no one is accountable for their actions! Anyone who watches the news or reads any of the newspapers from around the country will agree there is no justice for anyone in American courts. Murders, rapists & thieves all walk free! Get a grip people! Bad decisions are made all the time. Rep Harbin made one when he drove while impaired but no one got hurt...his car and a light post got damaged...that’s it! When did this become worse than murder or breaking into other peoples homes or any of the other injustices that happen every day? We learn from our mistakes & Rep Harbin will relive this mistake for the rest of his life thanks to the newspapers, radio, TV news and bogs. At least the rest of us are able to quietly thank God that no one got hurt, resolve to never do it again and move on with our lives. I thought we were a Christian nation...where is forgiveness?

No, I'm not misguided, it appears that you are. I have a friend who works in a defensive driving school and not only do delays happen all the time, DUI's are often knocked down to reckless driving. And this is for everyone, not just politicians. Why do you think so many of the defensive driving schools are against the virtual driving classes? If you don't believe me, visit one of the schools in your area. If you want to be in politics, you need to keep up!

Sound to me like you have a friend or relative that is a State Represenative. If no one is accountable, why is Charles Walker, Robin Williams, Michael Vicks, Linda Shrinko (sic) and so on in jail? No, Harbin is no one special and his behind need to pay. First, I keep up with politics, not because of any relatives or friends but because it affects my life. I'm almost 60 years old and I know how important it is to be an informed voter. Walker, Williams, Vicks and Schrinko were about money. That's why they are in jail and it took the Feds to do it! I never said Harbin shouldn't pay, but I said there were bigger crimes. Bully for Hypocrites2008 for never drinking but I have. I don't drink and drive but I did in my younger years & I realized how stupid it was and how lucky I was not to have hurt someone. It was a slap on the wrist back then. it took MADD to make it the crime it is today. I am not sugar coating anything, I am pointing out what is happing today in our courts. It isn't just Harbin's case that is treated this way. And I certainly don't condone DUI's being dropped down to reckless...I said this was one of the reasons schools are against virtual driving schools, (as am I.) LBenedict says Harbin has refused to atone for his actions...you don't know that! What, you offended because he didn't ask for your forgiveness? And, yes Hypocrites2008, I do consider Harbin to represent Columbia County well. I was here when all of Columbia County's projects got cut from the budget. I heard Speaker Murphy say Columbia County didn't need the money so they gave it to other counties and let our libraries, hospitals and schools fend for themselves. Tell me what you have done for Columbia County lately?

It's not dislike, nor is it personal. Now had he killed or injured someone near and dear to me, then yes, it would be personal. And yes, my extreme displeasure with him is evident, and I'm probably not the only one. Look at his legislative record and see for yourself...I did. Hiding behind his prestigious and powerful position and law firm is a sign of irresponsibility and cowardice, which are not admirable traits in elected officials. No. He refuses to speak with anyone...he is in deep hiding, which, in my view, is not being accessible to his bosses, the ones who hired him. I did get something in the mail from him a few months ago - it was an invitation to a fundraiser for him...yeah, a fundraiser...in Atlanta...when the legislature was not even in session.

Why has the Solicitor's office had to continue the case? Maybe they know they have a weak case and are not confident they can win with the evidence they have. My guess that this is a Dem Solicitor's office playing politics with Harbin, the Republican Appropriations Chairman. The longer they delay, the more likely public outcry could push Harbin into making a bad deal.

Having a lawyer speak for him is being smart and responsible and the American way. I do look at his record and don't believe anyone could have done any better. With the Governor, the Senate and the House all fighting, it is amazing that anything got passed! Also, you don't know that he has refused to speak with anyone, you only know he hasn't spoken with anyone you know or anyone who came out and announce it in public. For all you know he has spoken with his minister who would be violating his ethics if he spoke about it in public. As for fundrasing invitations for events in Atlanta...there were 6 fundraisers in Atlanta just yesterday for Republicans and 3 for Democrats! Aren't you the same L. Benedict that announced in April that you were running against Harbin for House District 118 and lost to Bill Jackson for Senate District 24 last year? This is just your idea of a campaign issue. If you are running, I hope you have few real issues.
