The Georgia Supreme Court reversed an Augusta murder conviction Monday.

The state's highest court ruled Calvin W. Foster was entitled to a new trial in the Sept. 27, 2005, shooting death of estranged wife, Daphne J. Foster, 34.

The Richmond County Superior Court jury that convicted Mr. Foster in 2006 should have been given the legal definitions of "guilty but mentally ill" and mentally retarded."

The jury also should have been told that if convicted as mentally ill or mentally retarded, Mr. Foster would be incarcerated, the Supreme Court ruled.

Authorities seeking woman's attacker

Aiken Public Safety is seeking a man who followed a woman from her job to her southside home and attacked and robbed her.

Lt. David Turno, the spokesman for the department, said in an e-mail Monday that the man was in a white, two-door car.

The incident occurred Thursday evening in the Gatewood neighborhood.

Investigators are asking that anyone who might have seen something suspicious in that neighborhood, or the vehicle in downtown Aiken, contact Detective David Savage at (803) 642-7687 or CrimeStoppers of the Midlands at (888) 559-TIPS.

Callers will remain anonymous and could receive a reward between $50 and $1,000.

Robberies involve force or threat of force. It sounds like the Sams Club incident was only a theft. Unless there was force used, just not mentioned in the article. In any case, to run out the back door of the Sam's Club is quite a feat, since the computers are up in front.

Man..these thugs walked in bold as brass with the camera right on them. Unreal.

Evans Ga.

Great, just one more case of letting someone off because they are screaming that they are mentally ill.

get.the.beam.out

No, Evans, it involves the law and what should be told to the jury in order for them to properly decide the case.
