Judge Duncan D. Wheale made it official Tuesday -- he is resigning.

Duncan D. Wheale: Superior Court judge turned in his resignation well in advance so his replacement can be ready to start next January.

Judge Wheale, one of the eight Superior Court judges for the Augusta Judicial Circuit, submitted his letter of resignation to Gov. Sonny Perdue on Tuesday. It will become effective Jan. 5, 2009.

"I know it is unusual for you to receive resignations this far in advance, but I knew that with the Legislature in session, it would probably take five or six months for the process to be completed," Judge Wheale wrote.

Judge Wheale said he hopes his replacement will be named early so the new judge can start immediately next January.

Judge Wheale was elected in 1998. With 10 years of service on the bench, he is entitled to a state pension.

Judge Wheale and his wife are moving to Charleston, S.C., where he will do volunteer work at The Citadel. The judge and one of his sons are Citadel graduates.

Mr. Perdue is considering another judicial appointment for the Augusta Judicial Circuit. He will fill the Superior Court judgeship formerly held by Neal W. Dickert, who retired in November.

In the past five years, there have been a number of changes on the Superior Court bench in the Augusta Judicial Circuit:


- Robert Allgood resigned in 2003 (Governor appointed Michael N. Annis)


- Albert M. Pickett retired in 2004 (Sheryl B. Jolly elected)


- William M. Fleming Jr. retired in 2006 (J. David Roper elected)


- Neal W. Dickert resigned in November 2008 (governor to appoint)


- Duncan D. Wheale resigning in 2009 (governor to appoint)

Very short term as judge-wonder why? This news really made my day!

His term may have been relatively brief, but he made a difference. He didn't like the way the courts were run and he did something about it. We are all better off because of the service of Judge Wheale. He will be missed.

We need a black lawyer nominated for his position. I hope our governor will consider it. There are 7 white superior court judges and only one black. I don't want to hear about qualications.
I want to hear about fairness.
Since a large percentage of blacks go to superior court, let nominate some black judges.

Rozzie2003 - what a atatement - don't want to hear about qualications, want to hear about fairness. Are you saying that you don't think there is a qualified black person to fill the bench? Please Judge Wheale stay - look at the mind set that trys to set the leadership.

I don't think there are enough whites, asians, american indians, eskimos, latinos or midgets in pro sports, to be fair shouldn't there be slots for them on every team?

J-10 Jeep, your analogy doesn't cut bait.The pro sports that have more blacks, football and basketball, are based on talent. Judges are political appointees and some black judges are needed. There are plenty black lawyers to be selected. Georgia has about 35% black population and very few superior court judges. Same goes for governor's executive orders, appointing blacks to state-wide boards. I have checked this out and only 9 blacks were appointed to state boards out of 150 appointees last year. Check the state employees and most of them are whites.Some departments like the Revenue are mostly lilly white.

jhall, what I meant about qualifications, many times , whites say they want the most qualified person as if the Black s aren't qualified.
Whites need to be fair and share positions and power among all ciitizens.
I want you to read the slave history of our country and see how poor whites felt about slavery. Many of them felt that slavery denied them jobs and opportunities, and many want to unite with the blacks. The slavemasters used propganda to show that the poor whites were better than the slaves. Many poor whites were tramps and ho-bos during the slve period of our country.
