Medicaid refusal appealed

The wife of a south Augusta pharmacist convicted of health care fraud is appealing the state's refusal to allow her company to service Medicaid pharmacy patients.

Tereses Inc., doing business as Peach Orchard Drugs, filed the case against the Department of Community Health in Richmond County Superior Court on Friday. Terri Fordham, the wife of Duncan Fordham, who is serving a 52-month prison sentence, owns at least part of Tereses.

She is challenging an administrative hearing officer's decision on Dec. 22. It supported the Georgia Department of Community Health's decision to deny Ms. Fordham's application to be a Medicaid provider qualified to receive reimbursements for medical prescriptions.

At stake is millions of dollars. According to court documents, from January 2001 through June 2005 Mr. Fordham received $12.2 million in Medicaid reimbursements for prescriptions at his Duncan Drugs store on Peach Orchard Road.

Mr. Fordham lost his Medicaid provider standing after his heath care fraud conviction in May 2005. He was convicted with former state Rep. Robin Williams and three others of crimes related to the looting of the Community Mental Health Center of East Central Georgia.

Mr. Fordham was given a contract to run the mental health center's pharmacy. The contract included extravagant bonuses, one-third of which he kicked back to Mr. Williams.

State medical-care fraud investigators contend that on the same day a federal jury convicted her husband, Ms. Fordham took steps to create a shell company that would enable him to stay in the pharmacy business.

She opened Peach Orchard Drugs under the corporate name of Tereses Inc. It occupies the same building as the former Duncan Drugs and has the same telephone number, according to court documents.

The administrative law officer determined that he did not have to decide whether Tereses Inc. is Mr. Fordham's "alter ego," as state investigators contend. The state was justified in denying the application because Ms. Fordham did not completely and truthfully comply with the application requirements, the law officer determined.

Mr. Williams, who was sentenced to 10 years in prison, and Mr. Fordham are each responsible for paying more than $1 million in restitution to the center.

Judge James G. Blanchard has been assigned to preside over the appeal. No hearing date has been set.

From my experiences observing

From my experiences observing husband wife relationships, they have always seemed to possess the same values. If my husband were in the business of defrauding the government, I believe I would know and would have made him stop or turned his butt in, surely there would have been a divorce to say the least, if I found out. The government would not be able to trust her, either. She needs to go sit down, too!

her husband is locked up.she

her husband is locked up.she opened a business to support her family.the building was avaliable and the number familiar to the elderly. so what. sometimes people don't look at the good side of people. ms. fordham is a good woman, who has accomplished something i might have given up on. it was a terrible struggle. but she did it legally. alter ego my tail. let this woman have peace. we as women should stand behind all woman who are this strong.(kf)

Ms. Fordham should not be allowed to own, operate, or profit from any company that has anything to do with the government, medicaid/Medicare, insurance or even medicines/pharmacies. She profited from the scams of her husband and the others.Enough is enough. Why do we continue to allow people to steal or take advantage of the system? When the time comes for the Fordhams' and Williams' of the world to ask for Medicaid/Medicare will they get it? I vote no! They have already gotten their piece of the pie. And who paid for it? You? Me? Our Parents? Our Children?

Duncan is a good man inside

Duncan is a good man inside and out! He would have given you the shirt off his back! There aren't many men like that anymore! Mrs. Fordham had to do what she had to do as a mother to provide for her family. This was what she knew how to do and she is doin a Damn good job at it and with keeping her head held high through all this mess. Yes any woman would have walked away, but Mrs. Fordham supports and stands by her husband 100%. I wish there were more women like her!

The court case against Mr

The court case against Mr Fordam was a contract issue,not direct Medicaid faud.The board for Community Mental Health approved the contract as well as the board attorney.Community Mental Health and Medicaid have been reimbursed for their losses and Mr Fordham has lost his assests as well as doing his time in prison.When is a family held responsible for a persons actions.Duncan Fordham has nothing to do with the store.The employees,who needed a job got together to open the store.This is pretty pathetic that this is the only news that continues to be brought up. This must be a personal issue.my opinion5 your right Duncan would have gave you the shirt off his back and anything else you needed.If you ever went in his store you would know this and you believe in him.I do and the thousands that have come to Peachorchard Drugs to support his wife and kids do too.

dakccb You must have personal issues with Mr. Fordham. You do not have your facts. It was okay for Community Mental Health to lose tens of thousands of dollars per year. Maybe you should read the newspaper in 2003 when CMH did not bill medicaid within the time allowed and lost almost 2 million dollars, but that was okay. It was a good business decision to open in the same location with the same number. duh

Duncan would not take any thing from anyone if you remember he was not charged with conspiracy.Last time I looked conspiracy means knowing and planing to take something or do something that you knew about.All the other men was charged with this but Duncan Fordham was not.The medicaid fraud part will come out in his appeal. My God he was in with Robin Williams.(Not friends)just business.One day the truth will come out that a good honest man went to jail for something he didnt do.Just so an enemy could have the last laugh.IT is a shame that so many people has had to get hurt in the process.

Just a few lines to Thank Duncan Drugs,Peach Orchard Drugs whatever name you want to call it. I have been a customer for over 25 years and and will continue to do my buisness there.
Duncan Fordham denied the buisness transaction several times but Robin Williams kept on and on until he talked him in to changing his mind. He got caught in the middle of Robin Williams and his mess. Duncan Fordham would have never ever taken from anyone. He is the most giving person my family has ever met. As far as his wife, she is doing an excellent job filling Duncan's shoes. She is just as caring and sweet as he was. If you are looking for a hometown pharmacy with great prices thats where you need to check out 706-798-3253. They have alot of $4.00 prescriptions.
