Family to split singer's effects

James Brown's 5-year-old son and the child's mother were excluded from the late singer's will that was read Thursday, according to an attorney handling his estate.

Aiken attorney Strom Thurmond Jr. said Mr. Brown's six grown children are in the will, but not James Brown Jr. or Tomi Rae Hynie Brown, who is either the entertainer's widow or ex-girlfriend pending the settlement of an ongoing dispute.

The will calls for Mr. Brown's personal effects to be divided equally among his children, one of Mr. Brown's attorneys, Debra Opri, told The Augusta Chronicle. Mrs. Brown was not present for the reading of the will, but Mr. Brown's adult children attended.

The Irrevocable Trust Agreement of James Brown won't be divvied up, Ms. Opri said. The trust controls the music icon's legacy, music rights, persona and 60-acre estate in Beech Island. The trustees are Mr. Brown's longtime attorney Buddy Dallas, accountant David Cannon and former South Carolina magistrate Alford "Judge" Bradley.

Ms. Opri would not comment on the value of Mr. Brown's estate.

"He was a very, very wealthy man, and all of his estate is in that trust," she said.

Mr. Dallas also would not discuss details, deferring to the probate attorney, Mr. Thurmond. Mr. Dallas said the document will be filed in Aiken County within the next two weeks.

Contacted by telephone, Mrs. Brown said she wasn't aware of the will reading, and she said she would contact her attorney in Charleston, S.C., to find out why she wasn't notified or allowed to participate.

Her attorney, Robert Rosen, said he will ask Mr. Thurmond to send him a copy of the will.

"We obviously cannot take any action until we see the will," he said.

Mr. Rosen said he's prepared to take Mrs. Brown's claims that she is the singer's widow to the South Carolina Supreme Court if necessary.

Mr. Brown's attorneys contend she is not his widow because she was still married to another man when they said their vows, and because those vows were never renewed once her first marriage was annulled. They also have hinted that her child isn't Mr. Brown's.

If her marriage to Mr. Brown is upheld, Mr. Rosen said, under state law she would be entitled to one-third of his assets regardless of what the will says. If the will is deemed invalid, Mrs. Brown would receive 50 percent of his assets, with the remaining half divided equally among his children, Mr. Rosen said.

Mrs. Brown said she and James Jr. are currently living "out of suitcases" in Los Angeles. She said she was registering James for school Thursday when a reporter called.

She repeated that she is eager to have a paternity test performed to prove that her son is Mr. Brown's child, and she wants the sample tested against his other children - daughters Venisha, Yamma and Deanna and sons Terry, Larry and Daryl.

"They all know that's their little brother," Mrs. Brown said.

A final resting place for Mr. Brown has yet to be determined, his gold coffin still sitting inside his Beech Island home since it was brought there after his Dec. 30 funeral.

Charlie Reid Jr., manager and funeral director of C.A. Reid Sr. Memorial Funeral Home, said Thursday that the family is leaning toward placing the coffin in a mausoleum somewhere on his estate, but no final decision has been made.

Everyone is entitled to their own opinions, but this is a HOT MESS! I hope he's buried somewhere before Dr. King's Day! If James Brown didn't want Tomi Rae, why would he leave her along? And as soon as it was known that she was married to someone else, why wasn't the DNA Test done then? Money is truly the root of all evil!!! I'd bet since the children wanted that "solid gold" casket, since they didn't get anything, they probably put James Brown in a pine box!!! My concentration would be on WHERE WAS PRINCE AND ALL THE OTHER STARS THAT STILL HIS MOVES!! Little Richard was just in Biloxi, Mississippi performing for the weekend, he could have gotten there in plenty of time!! JAMES BROWN, DEAD 12-25-06----BUT, we're still on God's timeclock, let's make sure our lives are together for our PayDay!!!

James Brown is a pathetic excuse for a human being. Forget the wife for a minute, he brought that little boy into this world and left him nothng! no college tuition, clothes, food, shelter, not even the basics to survive. James Brown there is no way God would except you by his side for the injutice you have brought upon that child. It is my hope that Mrs.Brown get's vindication and they can live the life they have been accustomed while James lives his in HELL.

I'd like to know what happenedafter the service at the arena. Did the family accompany the body to the estate or were they not allowed on the grounds then too? Who made that decision? Buddy?
If so how do we know if Buddy is saying the truth? Who is Buddy anyway? I know he is an attorney, but he has more authority than I've ever seen. More than "wife" or children. What's up with that?

I cant beleive the whole word is sitting and watching Mr. Dallas get rich off Mr Brown money and the older kids are so money hungray they will agree to anything just to be part of the will. Its disgusting! I never liked Mr Brown or his drug problems but his kid needs to be taken care of. Anybody living in Beach Island knows Tomi Lived with Mr Brown and presented herself as his wife therefore in the publics eyes they were man and wife so people get over it and give her his house and means to take care of his son God Will make Buddy Dallas, accountant David Cannon and former South Carolina magistrate Alford "Judge" Bradley pay for not taking care of James Brown son and you the public for not taking care of one of our own

At 68 yrs of age with prostrate cancer, Tomi would have had to take fertility drugs to have gotten pregnant by Mr. Brown. No doubt she may have. The little boy has heavy eyebrows like his mom. Any man of color could be the father. Where was his grown son's during this time period.

james brown said the little boy was his on national t.v. they say only the funeral director was on the grounds, but excuse me, my pastor had the same exact coffin last june, solid gold and it took almost double pallbearers to carry it, his was 18k and james brown was 24k so, who helped carry the coffin in the house??? buddy? who in the sam hill is buddy? i think he used his money to help jb and he put dibs on the house and everything else in a made up will and jb signed something he didn't read!!! yes, the loud mouth daughter took him to court!

He was trying to use slang...actually they showed the funeral again yesterday---I believe BET will air it entirely too...I live up in Buffalo, NY and our BET shows clips every night....You know, I'm so glad Gerald Levert died quietly.....After keeping JB in his living room or bedroom in his coffin two weeks after the funeralsssss, I'm not mad for Gerald's mom cremating him....Tomi Rae---well even if she was just 36 and screwing the Godfather, I hope she 's at least telling the truth about the $80,000 she suppose to have gotten, just for that!!! But, that voicemail message was James Brown a day before he died, but he certainly didn't have things in order...but check out the photo of Buddy on the front page under Legal Problems....This is like a Soap Opera for real, and I was just about to give up on Young & Restless because the storylines are stupid and here comes "THE BROWNS" and not Tyler Perry....Just BURY THE MAN if one of the children have cremated him for not getting money----LOL----I'll look for you online Monday or Tuesday---Happy Dr. Martin Luther King, Jr. Day---and don't forget to say that to the "Real light skinned folks.....lol

Let's see how many lies have Tomi Rae told between the death and funeral. It appears she lied and got the big pay back. She married him under a lie, then the marriage was annulled. She isn't his widow or wife. JB worked hard and probably knew he was getting ripped off.
Look folks, he put everything in a trust back in 2001 to the attorney. She claimed she got $80,000. She got the money more than the other children.
It appears she (Tommi) apparently, knew she wasn't going to get anything that she is screaming foul play so she can force to get something.
I read her reviews, and watched the talk shows and she has told too many lies.

It was JB's money, let it be, let it go, and let's worry about our issues and worry about what our incompetent president is going to do to this country.

I have never seen anything like this in my entire life from the fighting over the will to him not being buried. How long is he going to be kept in a house with a controlled cooler it's really sad even after other people who have had an impact on people die they are buried immediately(presidents,politicians,entertainers,etc...).I know he wanted his home to be turned into a musuem but do he have to be inside his house until the poject is complete have anyone ever heard the term rest in peace because it really applies here.

The man has been dead since December 25th - BURY THE MAN - HOW DISGUSTING & RIDICULOUS! His hometown was BEECH ISLAND, not Augusta! I have an idea - Augusta can honor him by moving the 'James Brown Arena', his statue & the stupid pedestal to his 60 acres in Beech Island and let that become his museum. hello, james brown only went to 3rd grade..mr dallas could have written the will anyway he wanted to and told james to sign..i hope all the so-called children will get tested and the real children should fight mr dallas and contest the will or at least keep it caught up in the court system for 50 years so that mr dallas will not benefit from fraud!
