Police were called to Lewiston Elementary School on Wednesday to investigate the spanking of a kindergartner.
Columbia County sheriff's Capt. Steve Morris said no action was taken against a substitute teacher who is accused of spanking a 5-year-old girl once on her bottom.
"This does not rise to the level of a crime," Capt. Morris said.
Police responded to the school after receiving a report from the school's principal that the child had been spanked in her classroom.
The pupil misbehaved in physical education class and became "disruptive, irate and out of control" when the physical education teacher suggested that the substitute take away the girl's "stamp or smiley face or something, you know how they do different things for good behavior," Capt. Morris said.
The school nurse examined the girl and found no injuries. Capt. Morris said that because the substitute made several attempts to calm the girl and no intentional harm was inflicted, no action was taken against the substitute.
He said any disciplinary action will be left up to the Columbia County school board.
