Newspaper is cleared of libel

A judge has thrown out a libel lawsuit filed by a fired Richmond County teacher against The Augusta Chronicle.

Judge J. Carlisle Overstreet granted the newspaper summary judgment Friday, ruling that a March 1, 2005, report about Brenda C. Wynn was fair and accurate.

Ms. Wynn was fired by the Richmond County Board of Education in September 2003. After the Professional Standards Commission recommended a one-year suspension of her teaching certificate, Ms. Wynn appealed and an administrative law judge held a hearing Feb. 28, 2005. The Chronicle reported on that hearing.

"... If a newspaper article is based upon a judicial or courtroom proceeding, the article is fair and accurate, and no actual malice exists, then the defendant newspaper or reporter is entitled to summary judgment," according to Judge Overstreet's order in Ms. Wynn's Richmond County Superior Court lawsuit.
