HIV-positive player is set free by judge

In Surrey, British Columbia, a provincial judge ordered Canadian Football League linebacker Trevis Smith freed on $10,000 bail, but also ordered the HIV-positive player to abide by a string of conditions, including that he use condoms, that he keep out of bars and night clubs and that he not be alone with any women other than his wife and immediate family.

"You must take reasonable precautions," Judge M.H. Thomas told the 29-year-old Smith, who is accused of aggravated assault.

The judge even specified that the football player must use "latex or polyurethane condoms" during intercourse and "dental dams" during oral sex.

Smith, a U.S.-born athlete who has played football for the Saskatchewan Roughriders for the past seven years, is alleged to have knowingly denied his HIV-positive status to a woman with whom he was having sex.

Smith denies the charge, which was issued as he traveled to football practice last week.
