Augusta is honored that two natives -Richard Story and Frank Hull (that's right, she's a woman named Frank) - are nominated for lifetime federal judgeships. It reminds us that the U.S. Senate must confirm only strict interpreters of the Constitution, so the following two questions are ones senators should ask such nominees:
Do you believe the Constitution is a "living document"? If so, does this mean the court has the power to "adapt" it to current conditions? If so again, what defense is there against a runaway court that arbitrarily changes the meaning of the Constitution to suit its own preferences?
If you consider the 10th "states' rights" Amendment a vital part of the Constitution, can you explain the rarity with which federal courts invoke it?
The answers will be illuminating.
