Does Obama know the law?

  • Follow Letters

Recent comments made by President Obama – disparagingly calling the U.S. Supreme Court “unelected” – urge many of us to ask: Has he ever actually read the Constitution?

Surely a graduate of Harvard Law School has read the Constitution. Maybe with all of that community-organizing back in Chicago, and his heavy workload in the U.S. Senate for three years, his recollection of this document’s content has gotten a bit rusty.

If the president has indeed read the Constitution, how could he forget Marbury v. Madison (1803), and subsequently the power of judicial review as handed down by the great Chief Justice John Marshall?

Obama’s comments also suggest that he doesn’t understand, or has forgotten the concept of, separation of powers and how the judicial branch operates within a system of checks and balances. His comments leave many to wonder.

Though not a liberal, I think

Though not a liberal, I think there's too much of an uproar over our president's remarks about our unelected Supreme Court. I'm old enough to recall the uproar made after the same court, led by Earl Warren, overturned the will of the people by forbidding organized prayer in government schools. At one time, then-Senator Strom Thurmond was proposing that a new high court be established, the Court of the Nation, to review the Supreme Court's decisions.

That said, I hope and pray that the Supreme Court will find Obamacare unconstititutional. Question is which way Justice Anthony Kennedy will vote. Some of his comments suggested that he will vote against Obamacare. As Rush Limbaugh has noted, however, later comments suggest that Kennedy is agreeable to the government-mandated purchase of health insurance.

Perhaps he is a product of

Perhaps he is a product of the social promotion mentality that has plaqued the african-american community. We have young adults who can't read nor write after graduating from high school, then many go on to college (with the same lack of skills and in need of enhancement classes to prepare them for regular courses). Because of the Google effect we have college graduates and PhDs who have little knowledge in their long term memory. Reminds me of friend who went to seminary complaining all his professors teaching theology were atheist. They can talk about it but don't understand it. Perhaps Obama can talk about it but doesn't understand it either. Either way its seems incredibly childish or arrogant to draw a line in the sand and dare them not to cross.

hussein knew what kind of mess this would create from it's beginning. How it would divide the population, how much regulation it would require, how many more government employees would be added, and how it would pit one section of the government against another. Why do you think that we need a peacetime martial law mandate all of a sudden?

Well Obama has hinted if the Congress or Judicia don'tl follow him then he feels just to override there authority-the end justifies the means. Basically reminds me of the Benito Mussolini. He does seem to try to stimulate political violence and division-a guiding principal of fascism.

BHO is FDR the Sequel. The

BHO is FDR the Sequel. The 1933 NIRA was declared illegal in 1935 by the SCOTUS. FDR threatened later to "pack the Court" by increasing the number of Justices to 25 of which he would pick 16 and his Democrat-controlled Senate would approve them. Will BHO do the same? The law students at the U of Chicago probably got a bad education from BHO.

It does appear that

It does appear that "division" is a part of what Obama is about. The Martin killing, the Masters accepting women members ...intent is to divide.
He has his reasons, thus all the secrets, but Obama knows.....
His plan is working.

I hear that sconservative.

I hear that sconservative. We've all had the college professor who basically professed their vision of a topic, rather than encourage critical thinking, facts, and knowledge. You can tell Obama likes to lecture people his vision, and will actually use misinformation and untruths to support his vision rather than create a true argument with merit.

It's divisive for a president
Unpublished

It's divisive for a president (any president)to speak on anything publicly without having the facts...the same thing he did with the Gates issue. For someone that claimed he would bring all races together he sure hasn't proved it with his actions. By the way, he isn't the only president that's done this, but he's the one in office now.

The question "does Obama know

The question "does Obama know the law" is easy. Of course he does. But I think it's more likely that Sotomayor (who should have recused herself)let him know that the vote the justices routinely take after oral arguments such as these made it clear that this un-constitutional law will be struck down. And by an overwhelming majority...So his rhetoric is a pre-emptive strike...albeit a clumsy one....clumsy as his whole Presidency has been...

Maybe he is a pseudointellectual like Ward Churchill and just made up his credentials. People do that stuff all the time nowadays. I can't imagine that would be the case but stranger things have happened.

As with everything else,

As with everything else, e.g., the individual mandate of ObamaCare, all it takes is Obama's support of a position for Republicans to drop their long-held support of said position (in this case, judicial restraint regarding the will of the people via Congress and the Presidency).

I'm actually surprised they didn't drop St. Ronald when Obama expressed admiration for him a few years ago.
