How can a convicted drug dealer land on the city's payroll?

When the city of Augusta hired Troy Curry as a laborer in January 2006, and basically rehired him as a meter reader in 2008, he had a nearly 20-year criminal record, including as a drug dealer.

Surprise. He was arrested recently for allegedly selling crack cocaine along his route.

If true, the city basically hired a crack deliveryman.

Nor have the courts covered themselves in glory in this case: Curry was handed a total of 15 years in prison for convictions spanning 1996-2005 -- and, obviously, wasn't even in prison when hired in January 2006.

How could this happen?

The biggest problem may be American labor law: Apparently, a criminal can't be "discriminated" against if the crime in question doesn't directly relate to the tasks required by the job. In addition, according to the city's Human Relations Department, the use of criminal background checks is frowned upon by the federal government.

Decisions not to hire or retain someone "based on the candidate's arrest record are generally improper and may lead to liability for discrimination under Title VII and state anti-discrimination laws on either a disparate treatment or adverse impact theory," says an article provided by Augusta H.R. Director Rod Powell.

In short, Powell writes, the federal Equal Employment Opportunity Commission feels background checks "can have an adverse effect on minority applicants."

"This is why we can't, per se, use criminal background information to disqualify applicants for jobs," Powell wrote to us.

Employers, the article says, must weigh the gravity of the offense, how long ago it was and whether "the job relates to the type of crime committed (e.g., a convicted embezzler seeking an accountant's position)."

Moreover, an employer apparently "must also evaluate whether the applicant actually engaged in the alleged misconduct" -- in other words, judge the job applicant's innocence or guilt for himself, notwithstanding any court verdicts.

Why would anyone hire anyone these days?

We don't know if this legal gobbledygook, or sheer incompetence at City Hall, is to blame. But the facts are the facts: The city of Augusta carelessly hired a convicted drug dealer as a meter reader, a position of some responsibility and contact with the public -- only to find he's been allegedly selling cocaine from his city truck. He was reportedly arrested with 8 grams of it, as well as $1,600.

He had been convicted of possession of cocaine with intent to sell just a year prior to his initial hiring.

One utilities director hired him as laborer, another approved his hiring as a meter reader. Both say they weren't aware of Curry's rap sheet.

We're not suggesting a ban on hiring those with criminal records. It can be a good investment in some people's rehabilitation. But the city has no written policy on it, and two department heads have admitted they had no clue of this man's particular troubles with the law from 1986 to 2004.

No federal law requires hiring with your eyes closed.

Because after someone has served their sentence they must be released from prison, perhaps?

LL; Just because the tax U-S-E-R-S are covering up The Great Court house Caper (which is a FELONY) does not mean the tax payers are going to forget this.

It is BEST practices and the law in most counties that the tax collector MUST deposit all funds on a DAILY BASIS. We pay a BRINKS TRUCK to come to the TAX COLLECTORS office on a DAILY to pick up the COLLECTED taxes. Oddly the week before the $25,000. Disappeared STEVEN KENDRICK REFUSED to DEPOSIT the cash that later DISAPEARED…He also REFUSED to close the safe after being informed that the safe had been left open.

One thing I know for sure

One thing I know for sure from this writer. There is no such thing as an end to a prison sentence in the writer's mind. They are all life sentences to him. There is no redemption; no salvation; no saving grace; in this writer's mind. Only the judgmental attitude of the christian hypocrite. An aspect of the south that I find MOST objectionable of all of it's frailties. I love the south, but the hate from this "reporter" surely represents the worst of what we are down here. In a society that tells you there is no end to your punishment. That there is no redemption at all for you, it's hardly surprising there is so little good in the hell that is our "justice" system.

I've addressed this before, but it bears repeating. Georgia's prisons are full. Whenever a judge sends a newly-convicted person to prison, one has to be released to make room for the new one. That is why people get released way before their sentence is up.

How was this guy hired in jan

How was this guy hired in jan 2006 and the DOC shows him being in prison from -2/2006-07/2006??? Did they not miss him? Gave him vacation? In another article it states he was hired in December 2006 another says 2007. Had only been out of prison less than 5 months dec 06. Can no one get their info right on this loser? Convicted felon, convicted thief,..... scum who needs to pull more than a quarter of his sentences. Another article says they have hard times finding people to take these low paying jobs without records. Whatever!!! Plenty of people would take that job who isn't scum. On none of the links does it show all of his records and charges, maybe thats why no one can really figure out this guys background. What good is a background check if everything doesnt show up? If it was January 06 he was hired, do they always hold convicted crack dealing thieving felons job positions? Boy the city really has no clue do they??? Evidently the Chronicle doesn't know either, they have Dec 2006, jan 2006, and 2007 as his hire date. No wonder Augusta is turning into a hole. No one in that city can do their job properly and they never actually punish criminals the way they should, then gives them city jobs to boot. Whats new, a bunch of incompetents, entitlements and criminals running the city.... old news. AC which is the real hire date? Does the city really have no clue when he was hired either? Thats the least they could try to get right. Un Fricken Real!!!!!

Tom are you serious? You bash this reporter, but yet don't hold anything against a loser like Curry? Do you speak from criminal experience too or just a blind bleeding heart? Redemption, how many chances should someone get? He's had way too many over his 20 year crime spree with very little punishment and got a good job and still is acting like a lowlife waste. What do you mean no end to his punishment? He barely got any to start with and wont stop committing crimes so why should there be an end to his punishment. Are you kidding me????????? Theres a line between compassion and common sense and you bleeding hearts don't know when to draw it and you are ruining this country.

Yep, wouldn't want any personal liberty to stand in the way of the law and order crowd. that crowd hates liberty and especially hates the ideals the country was founded upon. You keep speaking of redemption, but want it handed to someone and don't think they should earn it. Typical entitlement mentality.
