Report backs firefighter in discrimination case

A veteran Augusta firefighter said he was passed over for a promotion because he is black, and the city's Equal Employment Opportunity Office agreed.

Lt. William Dickerson filed a February complaint with the EEO office saying that Fire Chief Howard Willis promoted some white firefighters from an expired list of qualified candidates while denying him a promotion to captain because his name was on an expired list.

Fire department policy states that tests for promotions will be given every two years, with lists of qualified candidates to be valid for two years, according to a report of findings by EEO Director Jacqueline Humphreys on the complaint.

A firefighter since 1987, Dickerson was honored as Augusta's 2009 Firefighter of the Year for his efforts to save the life of fellow firefighter Jay Jones, who was seriously injured by a flailing water cannon during the 2008 blaze that gutted Southern Milling on Twiggs Street, according to Augusta Chronicle archives.

In her March 31 investigative report, Humphreys found that Willis promoted several fire lieutenants from an expired list during the same period that Dickerson was denied a promotion.

"There was no explanation as to why the promotion list was extended for other applicants who are white," she wrote, recommending that Dickerson be promoted to captain.

Administrator Fred Russell said an internal hearing on Dickerson's grievance was about to be held and that he will make a final determination on the validity of Humphreys' findings.

What were his scores compared

What were his scores compared to the other firefighters. Did he have a lot of write ups? There is more to it than just being promoted.

If Lt. Dickerson was told he was passed up because his name was on an expired list, and the Chief promoted others from an expired list, then it's possible the man has a case.

Yeah, because Dickerson didn't deserve it anyway, he only got honored as firefighter of the year. I'm sure those other guys were much more outstanding than that, yeah, he is only playing a card.....

In the spotlight twice and he is black; is this why he should be promoted? Were all of the promotions given to white firefighters? How did he perform on his job on a dailly basis? What about performance evaluations? How did he score on any test that were given? How did the white candidates size up? If he was the best candidate he should be given the job. But if the only thing that he has over the other candidates is that he is black, then heck no!

Dickerson needs to follow

Dickerson needs to follow Ronnie Few to Alabama. He'll promote him...he has the one qualification Few looks for....his color. It must be nice to have that "I'm black" trump card to throw on the table every time something doesn't go your way. Wouldn't HR have to approve the promotions anyway? If so, then the monkey is on HR's back, not the Chief's.

The "white" promotion he's

The "white" promotion he's referring to was a completely different case..the position was available before that list expired but the person wasn't promoted until after the expiration date.
In this case, the list had expired before the position became open, so I'll have to say he doesn't have a legitimate reason for even filing a "discrimination" complaint...but by filing it that way, he'll probably wind up getting it so "they" won't look like racists.
Well...IMHO... he really shouldn't be promoted off the list...they should've already given another test and have a list to work off of....but with the state of the economy...blah, blah, blah.

It's all a bunch of BS......

By the way...the last person promoted off of the "infamous" list....was a black person....but there was an opening at the time.....get it.

Why go through the cost of having a professional company come to town...administer the promotion process....have a list, that policy states is good for 2 years from the date of the posting of the list, but allow someone to make allegations of racial discrimination and GIVE them a promotion?????
From now on...let's just let everyone who wants to be promoted file false charges and see who wins!!!!

Ms. Humphreys' report tells

Ms. Humphreys' report tells us when the lieutenant filed his complaint, but it doesn't mention the date of the decision not to promote him. Since the law allows people just 180 days to file a complaint with the Equal Employment Opportunity Commission, the lieutenant's filing rights may soon expire, relieving the city of its liability. I wonder if he has already contacted the EEOC.

Nothing new here...just the same ol' patterns from the past being employed in contemporary employment situations. And even though it's obvious what happened, and even though it VIOLATES the law, the culprits will not be punished for their discrimination. Where is the deterrent to warn other backward thinking individuals? MIA! AWOL! Why? Because the laws were written to protect the exact same individuals who perpetrate such violations and the results of this case will demonstrate that fact. Yep, the "Report Backs Firefighter" is clear evidence that discrimination is tolerated within the firefighter leadership circles, but until proper punishment is exacted on those folks - nothing much will ever change.

Being the cynical, realist I am, I'd do away with the test for promotion. Promotions should be based on the opinion of supervisors. If a trend of racial discrimination develops, that can be fixed.

OK...the report that the EEO

OK...the report that the EEO put out...is WRONG...completely.

The promotion list was dated August 25, 2008 and according to policy, in effect for 2 years....August 25, 2010.

The original people promoted off that list was done on September 4, 2008 and it was the top 2 on the list...both white.

The next person was promoted on September 5, 2009....a white.

The 4th and final person promoted off that list was done on January 23, 2010....a black.

Dickerson is next on that list....so where's the whites that were promoted after the list expired???? THERE HASN'T BEEN ANY.....

So I don't know where the EEO came up with the information in "the report"...but IMHO it's only because the complaint filed had the magic word...discrimination!

After further research, it appears that the prior episode of promoting folks from a list happened in 2003 under Fire Chief Al Gillespie. At that time it appears that some were promoted after the 2 year period...but Dickerson was promoted to Lt at that time...he wasn't even eligible to take the Captain's test?
The list of 2003 was posted without a date...now if that was done on purpose or not I can't attest to but I don't see how it has any bearing on the current situation...but in the end I'm sure he'll get his way and shouldn't IMHO.
I have nothing against him but am tired of seeing people who don't get their way starting whinning and making FALSE accusations to get things the WRONG way.
He'll have alot of folks that will avoid him at all costs after this.....

You are obviously a bubba supporter and sitting in a fire station with nothing to do. So check you bulletins and find the one where bubba promotes richard johnson to captain, oohh let me help its # 27 dated 3-13-2006. Also check the date of the original promotion, oohh let me help again its # 74 dated 3-26-2003. Let me count hhhmm! that's about 3 years! So once again if you are gonna tell the story tell the whole story and stop trying to protect an unqualified fire chief!

And by the way the complaint is that in the past promotions were given off expired lists when there was no new list available! That is the exact situation now and what your beloved fire chief should have done what has been done in past promotions, or he should have given new test back in august when the list expired. Or maybe even back in September 2008 when he needed a new LIEUTENANT'S list! How about that?

if shakey willis promoted from a expired list, then dickerson deserves the capt. position. this is probaly the only chance dickerson has to make capt, so he pulls his race card to get it what a joke!!!!!!!this is not a racial issue and i dont see how the eeo lady came up with that. fight for whats right but dont say its a racial issue i call bs on that.
yes willis is a joke along with all the other upper admin they all need to be replaced and i hope soon!!!!!!!!!!!!!!

knokells....you are sadly mistaken if you think I'm a "bubba" supporter...I think he's probably one of the worst, if not the worst chief in the last 20 years...so that's the first thing you're wrong about.

Second thing....I'm not sitting in a fire station.

Third thing...if you have any comprehension skills you'd have seen that I told that story in the last post I made....Gillespie screwed the pooch on that and Willis had to pay the price...thus the policy of 2 years was put out.

Fourth thing...again with the comprehension...I stated that a test should've already been given.

If you want to discuss the facts of the story and Dickerson's complaint...we can do that.

The complaint states that the reason for Dickerson not being promoted was his race...which is complete BS....it's definitely not the reason...just like in the Richard Johnson scenario...he(Willis) didn't have a leg to stand on and thus had to promote him...so...if Dickerson had of went about this the right way and just used the fact that Johnson got promoted off an expired list then I'd be supportive of him.....but the fact he came out with the "race card" BS....shows, IMHO that he has no business in an officer's role if he has to resort to that instead of using the facts. He took the "easy" way out and obviously didn't feel that going about it any other way would get the result he wanted!!!!

I agree with fasthobby13....the entire administration needs to go away. All they do is sit in their offices and figure out ways to make the others look bad and their self look good....all the while, the people who actually do all the work are getting screwed everyday...no fairness in anyone in administration...unless of course, you happen to be "one of the boys" for whichever Chief you're dealing with at the time.

I'm sorry but you are wrong again.....the following is from the EEO report;

On February 10, 2011, Lt Dickerson filed a RACIAL DISCRIMINATION complaint of unfair promotion practice against Chief (CH) Howard Willis, Augusta Fire Chief. LT Dickerson alleged that he was denied a promotion to the position of Captain BECAUSE OF HIS STATUS AS A BLACK MALE.

Say it ain't so!!!!!!!!!!!!!!!

Couple of things to the two

Couple of things to the two firemen who keep posting, I am a firefighter so i know the truth. First i talked to dickerson and found out that he tried to talk to bubba and the city government but was given the run around. No one from the administation would even talk to him and you both know that if you are not on the bubba team you will be ignored! So after a month and a half! Drake retired on 1-31-2011! he felt like it was a race thing, by the way where are the memos about any officer testing to be given any time in the near future? Second of all dickerson took the test like everybody else and i think he has placed pretty high in the past except this time bubba had to help his two main supporters get promoted. Third thing you would be the kind to fall in line with a GOOD officer like Captain DUCT TAPE! I'm sure that if dickerson had done something like that he would have not only been fired, he might have been arrested too! So him helping to save jays life that's nothing! i sure wouldn't want to follow an officer like that!
