One man sought for simple battery after gas station incident

A teenager is being sought by police for simple battery after hitting an Augusta man Tuesday at a local gas station.

James Randall Birak, 59, was paying for coffee at the Circle K at 3298 Mike Padgett Highway when the suspect struck him in the back of the head with his fist, according to a report from the Richmond County Sheriff’s Office.

An unknown man then advised Birak not to retaliate because the suspect is on medication, the report said.

Birak stated Circle K employees have video footage of the incident. Deputies stopped by the Circle K to see about the video, but a Circle K employee said the manager had left for the day, according to the report.

The suspect is described as a black male, late teens, 5-foot-8 and 130 pounds. He was last seen wearing a yellow t-shirt, blue jeans and a brown hat.

Either way this is why everyone should constantly monitor their surroundings.

One other thing

Note the AGE and the victim and the age and description of the suspect. Attack from behind

This M.O. increasingly points a Failed Knockout game stunt.

This Game Player is lucky NOT, to be some mom-ma's innocent dead little baby.

but the story fails the mention the TIME.

ALSO
Pretty lame of the CK Mgr not to come back in, to show RCSO the Video to allow a quick arrest.

Now what if this fool does this again with harmful results?

I don't think the knockout

I don't think the knockout game will work in the South as well as it does in northern states. Too many people carrying, which may be a deterrent. If not a deterrent, look for some shot up thugs.

Retaliate hell.....I would have shot him dead as a door nail right there in the store. Bet they would have put some effort into getting the video footage then wouldn't they. I could give a flip less about his medications or mental status. He is dangerous and needs to be locked up or killed.

Like nocnoc said, pay attention to your surroundings. It's no longer enough just to carry a weapon.....you pretty well need to have your hand on it at all times if you are in public....especially at any South Augusta establishment. It's too late to be reaching for it after some low life punk coward has knocked you senseless from behind.

Did Others Tell The Attacker To Do It?

If the man is mentally handicapped in any way, it could be others put him up to hitting the man. That's a common tactic. I doubt he goes out to stores alone with that kind of mental illness. The person who intervened and seemed to know about the mental status of the attacker should also be found and questioned.
