Ex-deputy indicted on evidence charge

An ex-Richmond County sheriff’s deputy is being charged with tampering with evidence and violating his oath of office after findings from an internal investigation were presented to a grand jury.

Wade Smith, who had been a deputy since 2002, was terminated June 4 after an investigation into accusations he had improperly handled and recovered property seized from a defendant he investigated in November.

During the investigation, the sheriff’s office learned Smith had confiscated a large amount of marijuana, money and a handgun but did not document them in any report or recover the property correctly.

According to a sheriff’s office news release, Smith contended he had destroyed the narcotics, discarded the weapon and turned over the cash to a relative of the defendant.

Internal affairs fired Smith on the grounds that he violated policy and procedures. The findings were forwarded to the district attorney’s office for review.

On Tuesday, the case was presented to the grand jury, which indicted Smith on the charges.

According to the indictment, Smith is accused of disposing of evidence collected during the Nov. 2 arrest of a man named Charlie Davis to obstruct the prosecution of Davis.

A Charlie D. Davis Jr., 31, was arrested just after midnight Nov. 2, at 3037 Dent St. Officer Shane Van Dyke, who was investigating a report of a domestic disturbance, charged Davis with misdemeanor possession of marijuana, according to court records.

That case is pending trial in Richmond County State Court.

A warrant was issued for Smith’s arrest, and the sheriff’s office said Smith’s attorney was making arrangements for him to surrender.

and before some of you

and before some of you condemn him, he is a good guy and was a good deputy. i'm not going to guess or make assumptions regarding these charges, but good people some times do stupid things. it doesn't make him any less of a good person. keep your head up Wade and i wish you the best of luck!

Yes it does

make him less of a good person. He still may not be a bad person as such, but "misplacing" guns and drugs for a LEO is HUGE. Of all people, those working within the justice system need most to be above reproach.

If guilty as charged of course.

I'm NOT buying on this statement!! Good guy? Maybe, I don't know him personally so I won't assume either way on this.

But "Good deputy"? ABSOLUTELY NOT!!! As a Deputy Sheriff of 16 years, I'm sick and TIRED of deputies like this, giving us all a bad name!! Something absolutely STINKS with his story, I'm VERY confident in telling ALL of you that.

First of all, you NEVER destroy a LARGE amount of marijuana on your own. Second, you NEVER just discard a firearm, you turn them into the evidence room, if for nothing else; for safekeeping. Third, you NEVER turn a large amount of money over to a family member without having the OWNER sign a release form, to have it release to that family member. BUT, if their was enough marijuana for a Possession with intent to distribute charge; they money would have been seized anyway.

I've also never seen a Deputy give a warning for a "LARGE" amount of marijuana. Yes, certainly for small personal use bags, but not for large amounts; unless the suspect agrees right there to become an informant on BIGGER fish. BUT, you would still keep the evidence, in case this guy doesn't work for you, he can be charged later!!

This ENTIRE things stinks!! NONE of it makes sense and NOTHING he said makes sense. My sense is that he is LYING and was doing some dirty stuff, hence the indictment!! If he's found guilty, I hope he gets several years in prison!!

I think I know this Wade Smith.....from my memory he was/is a good guy.....will we hear more about this?

Let's get real here Ego

He smoked the pot, sold the gun, and pocketed the cash. Yeah, that DOES make him a bad person. To classify these crimes as "doing stupid things" makes me wonder about your morals. While I agree he didn't display the utmost intelligence when committing these crimes, I believe the truly "stupid thing" was thinking anyone would buy his story.
