Jury acquits men of malice murder

After hours of deliberations in the murder case of two men involved in a shootout outside an Augusta nightclub, a Richmond County Superior Court jury acquitted them of malice murder, finding them guilty only of possession of a firearm during the commission of a crime.
Marcus Washington, 23, and Devin Washington, 20, had pleaded not guilty in the July 5 shooting of Pr’Shawn Williams, 22. During the weeklong trial, each defendant claimed he fired only in self-defense.

Judge Sheryl B. Jolly declared a mistrial for one count in the indictment – felony murder against Devin Washington. The jury informed the judge it was deadlocked on that charge.

Immediately after the announcement of the verdicts, defense attorneys Jacque Hawk and Martin Puetz asked the judge to dismiss the weapon charge because there was no underlying conviction for another crime.

Assistant District Attorney Natalie Paine opposed the motion, particularly for Devin Washington, because she intends to retry him on the charge of felony murder.

Jolly will hold a hearing next week to hear arguments on the issue.

The two men, who are not related, had exchanged gunfire at least once before in Aiken County, authorities said.

The night of July 5, both men and friends went to Alter Ego’z. After they got into a fight, they were asked to leave the club in the 1700 block of Gordon Highway.

Williams, who was with Devin Washington that night, was in his vehicle’s driver’s seat when the shooting started. Williams was also armed and fired several shots.

I'm more than a little tired

I'm more than a little tired of footing the bills for these fine upstanding citizens to have their rights to "shoot it out" with one another protected. They have done this before?

Is anyone out there paying attention?

I cannot dispute the findings of the jury, because I was not there. But, was there a gun in the hands of a previously convicted felon involved?

What's the previos history of these citizens? Ooops can we not ask that question?

Was that the only charge that they could be tried for? Was their another charge they could have been tried for that would have made it easier for the jury to convict them.

A person is dead and no one gets punished for it, something is wrong here.

What is the definition of Malice Murder in the State of GA?

take up a collection and pay for them to take target practice in hopes they don't miss the next time they shoot at each other.

General Principles

Local jury which represents the views of the people has one viewpoint and the prosecutor another. Facts are secondary. However, it is possible the dead guy drew or fired first. Who knows? Hard to put them in prison for the killing even though they probably deserve it just on general principles.

It seems while out on bail, he crossed state lines, and committed an Armed Robbery, while awaiting trial for murder?

Ok. So at this point, I'm seeing more to this story than I did when the crime originally happened. I know realize that the victim was shooting as well. I thought originally he was just a bystander, however he was actively involved in the melee that night. Both were firing guns in a public place. Surely they should be found guilty of something! This must be the week of non-guilty jury verdicts

Just getting started

Child molesters walking, "not guilty" murders who provide recorded confessions. All I can do is laugh! For years the folks in Richmond County complained and complained about under representation of jury panels. Soon Augusta will look like Chicago and they will be begging for the national guard to police the streets at night. Now every person who has ever had a license is in the jury pool. Now the Justice System is a JUST-US system. Next time you go for a drive pay attention to the next twelve people you pass driving. Would you want them on the jury deciding if the person who raped your daughter, killed your husband, or broke into your home is guilty? And the defense attorneys are laughing all the way to the bank! Confuse one person out of twelve and get a hung jury and your client walks. Only the beginning folks!!! GET OUT NOW IF YOU HAVE ANY SENSE AT ALL!!!!!

lets profile shall we....okay we know "deys be black" but lets see they are both in their early 20's so da mamma's are probably approx 34-36 yrs old, the are probably high school dropouts or functional illiterates "given" their diploma (of which they probably can't even read them), no job skills, grew up in fatherless, "gubiment" project homes, they were fed and cared for courtesy of "foo stamps" and welfare checks and the same "fo da mammas" when they were growing up..what we have here is a product of a generation relying on the government for every need lacking the basic work ethic to even consider nothing more but a life of crime, drugs, and jail...but one thing you don't see are the so-called "cummunity or religious" leaders standing up and demanding black-on-black violence be stopped from within the black community or by the police..to do that would shine the light of truth right where it should be and that is on the same community that looks the other way when 7 out of 10 black children born are born into a single parent/unwed/illigitimate household thereby feeding the cycle of "gubiment" dependency, poverty, violence, drugs, prison, and early death that is destroying the black community..as long as they can preach "da prosperity" doctrine to fill their collection plates/building funds (to buy their high end Lexus-see the reverand of the church that is next to cherry tree xing) and blame "da white man and racism" then they will continue to look the other way
