An Augusta man remains jailed one month after police discovered videos of at least 100 girls that had been taken at public areas across the area.

Richmond County sheriff’s Investigator Mark Dobbins said officers at Augusta Mall were alerted to Adam Mizell on Dec. 2 when a woman reported seeing him taking photos of girls.

Mizell, 23, insisted that he had been using his cellphone to make a call. Officers, however, discovered that the “cellphone” was actually a small video camera.

Dobbins said Mizell was arrested immediately on an unrelated warrant.

On the camera, investigators discovered videos of at least 100 girls.

On Dec. 14, investigators added a charge of criminal attempted child molestation.

Dobbins said Mizell had been collecting the footage for about a year and had been using it for “his own sexual gratification.”

Investigators said it appeared that Mizell had been following girls around at the mall and various other unidentifiable locations and making videos of their buttocks and crotches. All the girls were clothed and probably unaware they were being recorded.

So far, investigators have been able to positively identify only one of the girls.

Dobbins said there will likely be more girls as investigators look at the suspect’s other devices, including his laptop.

Unusual Case...

There is no law prohibiting the photography of anyone, of any age, in any public area, anywhere in the United States. There is no reasonable expectation of privacy if you are in a place that the public can freely enter and leave.

Even though what this suspect is accused of doing is inappropriate, it will be a very hard case for prosecutors to win, unless there is some other evidence that we are not being told about.

They are benches in places

They are benches in places like South Beach dedicated to guys watching women walk past. I don't see how you can arrest him for what he did. Maybe a dad or boyfriend could punch him or something for good measure, but I don't see any laws being broken. It reminds me of Arab countries where women don't want to be photgraphed.

Child Molestation--

"Commit an indecent or immoral act to, with, or in the presence of a child under the age of 16 with the intent to arouse or satisfy the sexual desire of either the person or the child" Nope. Don't see where what he did was illegal under that statute. Criminal attempt means he took steps toward committing the act. Maybe he had the address of the identified girl or had made contact with one and propositioned her.

What is actually going on here?

1) "Dobbins said Mizell was arrested immediately on an unrelated warrant."

What warrant? What's this part all about?

2)"On Dec. 14, investigators added a charge of criminal attempted child molestation."

From what? Where? How? You can't say that unless you have proof. How can you jump from inappropriate videos to sudden molestation?

3) "Dobbins said Mizell had been collecting the footage for about a year and had been using it for “his own sexual gratification.”"

How can you prove that? This guy went to my high school and was in the AV program. He made videos all the time. Maybe he was just getting some stock footage for something? It's a stretch but you can't automatically assume that it was for sexual gratification.
