Richmond County investigator charged with sexually assaulting wife

A Richmond County Sheriff’s Office investigator was arrested Tuesday and charged with sexually assaulting his wife.

David Timothy Dutton was charged with rape, aggravated sexual battery, unlawful eavesdropping or surveillance and making false statements.  SPECIAL

David Timothy Dutton, 35, of Martinez, was charged with rape, aggravated sexual battery, unlawful eavesdropping or surveillance and making false statements.

Sheriff Ronnie Strength said he would be suspended without pay until a review board considered the case.

Dutton’s 27-year-old wife told Columbia County authorities on Nov. 12 that she was looking through her husband’s phone and found videos of them having sex the previous night, according to a Columbia County Sheriff’s Office report. The woman said she wasn’t aware she had sex or that it was filmed.

The woman said she took her prescription medication and went to sleep and doesn’t recall the sexual encounter, according to the report.

Dutton initially told deputies that his wife, dressed in black lingerie, consented. He admitted recording the encounter without her knowledge, according to the report. Dutton erased the videos and pictures after he took the phone back from his wife.

Dutton is being held in the Columbia County Detention Center without bond, according to jail records.

All they had to do was a blood test to see if she took her prescription. If that prescription has side effects such as sleep-walking, sex while asleep even if you are mobile constitutes rape. Besides, he should know better than to have sex with his wife after she takes her meds. The real question is why did he film it with his cell phone and how many times has he done this or something similar to her while she's technically asleep.

So if he's convicted I hope he likes being labeled a sex offender and enjoys having his picture posted every time he has to register for the rest of his life. I'm not saying he's guilty but a lot of people are convicted of sex crimes with their partner because she had the better story.

People beware Amiben can make you do many things you do on your own and never recall!! Mix with a little bit of wine and we have had stories of people going out side to work in flower beds nude, driving in the nude, waking up nude in odd places. We have no video and maybe he took it to show her what was going on!!! Amiben can be a very odd drug!!!!

I'm so lucky my wife and I don't have these issues. I can leave my phone out and she's more than welcome to go through it and see the stupid pictures of the kids dumb e-mails, texted grocery lists from her and other married do dads. I have no idea what's in her phone and wouldn't know how to work that Smarter-than-me thing.
Then again we're just an old married couple who couldn't and wouldn't keep asecret from each other. It's so nice to be settled sometimes!

I leave my phone out, my husband answers it and he is welcome to go through it anytime he wants. If you aren't doing anything wrong, why would it be a problem? I'm with shrimp, if you have issues with your spouse using your cell phone, you have way bigger issues than a cell phone. We don't keep secrets from each other either, if you are keeping secrets from your spouse, you need to go to the courthouse, the divorce is just around the corner. You can't put a price on trust, but you know when you have it, and you can't put a price on distrust- there isn't a number high enough.

WARREN v. THE STATE., 255 Ga. 151, 336 S.E.2.d 221
Rape is possible between a husband and his wife. However that ruling was based on another illegal act in Ga., that forcible sodomy had occurred. Also see Comer v. State, 228 Ga. 184, 185 (184 SE2d 566) (1971)... However, Reproductive style sex was not ruled on.

It all boils down to who can prove Who What When and Where and how often.

I hope this will get dismissed quickly and the judge will order mandatory counselling for both parties. They both seem to be attracted to dysfunctional relationships. The deputy should not loose his job over this unless there is much more to it.

Nothing to worry about

The story and the comments here make for an interesting read. This guy has little, if nothing to worry about, even if he's guilty, which is in doubt. Read 3 articles down, "Police Still On the Job After Misconduct". Buddy, since you work in Georgia, just file an appeal and that should keep you slamming people's faces on the hood of your car for at least a few more years.

I'm sure your comment was intended to address his chances of being convicted of a crime, but even if he isn't he's still pretty much screwed (npi).

I still say he's going to be just fine. He can be the Mark Fuhrman of Augusta. Fuhrman pled no contest to perjury. He lied on the stand. Also, he took the fifth amendment when asked under oath if he'd ever planted evidence. So, IMO, Fuhrman is even worse than Dutton, yet today Fuhrman is the police consultant for a major news network. FOX 40 in Augusta should hire Dutton in the same capacity. An ex-cop who's a little freaky in private. People would watch. Are you listening FOX 40?

Nope, they are going to get him for lying to investigators. Not to mention, all the cases that he is involved in are now tainted, a whole bunch of people are going to go free, and that is going to infuriate RCSO and the DA's office.

And then his soon-to-be exwife is going to get her turn in court. He's history. He's toast.

Why did you remove all the comments from the people that know the wife and her history? No one stated anything that was untrue, it's all documented in court records that she has had multiple arrest and problems with "self-medicating" for years. If it's okay to leave comments up that say "he's toast" and "I hope he like's being labeled a sex offender" then it's okay to leave up comments that state actual facts about the wife. I hope someone in the officer's family is reading these comments and takes legal action against you for allowing inflammatory comments about him to stay up while you take down the ones that defend him.
