Death penalty trial in 2008 killing of family delayed

A death penalty trial scheduled for Oct. 1 has been moved to an undetermined date in late January.

Adrian Hargrove faces execution if convicted of three counts of murder in the 2008 deaths of Andrew Hartley Jr., 45, Sharon Hartley, 46, and their daughter, Allyson Pederson, 18. He is also charged with feticide in the death of Pederson’s unborn child.

At a hearing Monday, two state-appointed capital defenders said they had been assigned the case only two months ago. District Attorney Ashley Wright did not object to their request for a continuance, saying the case is finally moving forward.

“We’re trying to do the work now that has been lacking, and it’s been difficult,” Wright said. “I am appreciative of efforts to get this case up to speed.”

Wright said she was recently presented with nearly 10,000 pages of documents from the defense. Hargrove’s attorneys have also presented a new mental retardation defense.

Superior Court Judge James Blan­chard granted the postponement.

Hargrove has pleaded not guilty to the charges, which also include burglary, kidnapping and possession of a knife during the commission of a crime.

The Hartleys were found in their Bennock Mill Road home Feb. 9, 2008, after Hargrove’s wife told police that he had arrived home with blood on his clothes. The body of Pederson, who was months into her pregnancy, was found near the Lock and Dam Road, not far from the airport. It had been set on fire.

Hargrove was released from prison in 2006 after serving seven years in prison for convictions of cruelty to children and possession of cocaine.
