Man accused of sucking teen's toe in Grovetown Walmart won't be charged

Authorities won’t charge a man accused of sucking a teen’s toes at the Grovetown Walmart.

The 18-year-old girl said July 10 that Joey William Leaphart, of Langley, tricked her into letting him suck her toes in the store, according to a Columbia County sheriff’s report.

Leaphart won’t be charged because the teen consented, sheriff’s Capt. Steve Morris said.

The girl said she was shopping when a man asked whether her toenails were painted. After replying yes and asking why he wanted to know, she was asked whether she had watched America’s Funniest Home Videos, according to the report.

The man told her he was with the show and said that if she complied with his requests, everything she purchased that day would be free. She reluctantly agreed to his taking a picture of her foot.

The man guided her to an area behind a clothing rack, dropped to the floor, grabbed her ankle and said, “Don’t worry. I don’t bite.” He then started sucking her big toe. The girl screamed at him to stop and told him to leave.

Before the man ran from the store, he told her, “It tasted so good, though,” according to the report.

Leaphart was previously arrested for similar incidents. He became a registered sex offender in Decem­ber 2000 when he pleaded guilty to performing a lewd act on a person under 16 for licking the toes of an 11-year-old girl. In 2002, a jury acquitted Leaphart of aggravated battery after a 22-year-old woman said he forced himself on her foot.

On Feb. 17, Leaphart was arrested and charged with solicitation for contribution after approaching women in North Augusta Plaza and asking for money, according to the North Augusta Department of Public Safety.

I wonder if ALL of you commenting on how much this guy is a sicko and dangerous this guy is are that naive also to think that doctors, lawyers, business owners and other people who you associate with everyday could not possibly be into some sort of 'fetish'. Yes this guy may be somewhat dangerous because he is walking up to complete strangers in Wal Mart and requesting to kiss their feet, but I guarantee you that your everyday person is into similar or even stranger fetishes. The coach of the NY Jets had a YouTube video a couple of seasons ago that showed him and his wife role playing and there was foot play involved.

I am concerned as to the reason given for the man's lack of charges on this offense:she gave consent. The man took advantage of this person(age does not matter, in my opinion), led her to an out-of-the way location and proceeded to commit an intimate act upon her beyond her agreement, it appears, and even so, once she screamed for help, that was it. I thought that at any time in such a situation, no matter how far things have gone, "no" means "no". (I do realize it does not clearly indicate that she said the exact words but you know what I mean). What if he had told the person that he wanted just a kiss and after agreeing, he proceeded to attempt to fondle her or rape her? Would he have been charged because she initially consented? This is disturbing, particularly since this has happened before and he is a registered sex offender. We all know what we think we would do in such a situation but in reality we really don't, so judging the victim isn't fair on that level. I just hope that another person doesn't fall victim to any sort of contact with this criminal. It makes for an amusing story in some ways but the joke isn't as funny once you change the crime around.
