Judge recuses himself from Augusta Commission bribery case

Superior Court Judge Carl Brown has recused himself from a case after his daughter was hired to represent David Fry on bribery charges.

The court order signed Dec. 6 shows that DaCara Brown was hired as the attorney of record Dec. 1.

“To avoid any potential conflict, it is therefore necessary for the case to be assigned to another judge,” the order states.

Records show the case is now assigned to Sup­erior Court Judge James Blanchard.

An indictment alleges that in August 2009, Fry offered Augusta Commission members Corey Johnson and Alvin Mason a contract to operate a parking deck if they voted to build the nearby Trade, Exhibit and Event Center.

He was later indicted on two counts of bribery.

In November, Fry was set to enter an Alford plea, which acknowledges a guilty verdict is likely but doesn’t admit guilt, and is treated as a guilty plea. After a back-and-forth discussion between Fry’s attorney at the time, Pete Theodocion, and Assistant District Attorney Adam King, Brown said it was obvious there was a disagreement about the definition of bribery.

He ordered the case go to trial early in 2012.

This is going to be one case where everyone in the courtroom and the community knows there is more to it than what comes out in court. We all have to play the little make believe game and smile. I say they start the court session with: "Once upon a time, David Fry..."

This trial needs to be moved out of Augusta. Too many big players involved. I suspect this is the work of The Cabal.

It is sad that Fry had to

It is sad that Fry had to hire Brown's daughter to gain a recusal. Brown should be ashamed of himself for not recusing himself at the beginning (or not even accepting the case in the first place). Why? Because Carl Brown has or had a business relationship with one of the businesses David Fry sued the city over for faulty procurement practices. That's a clear enough conflict of interest that Brown should have stepped down. Of course, Augusta is an in-bred town and many high-ups do not recognize conflicts of interests like they should.

I just wish D.W. Fry's would

I just wish D.W. Fry's would open back up in the old Timmerman"s building (which is long gone) and we could all go back to bar hopping from Fry's to Studio7!
