Judge was not target of break-in

After a second arrest from Friday's break-in of Superior Court Judge Carlisle Overstreet's home, authorities still doubt the suspects knew or were targeting a judge, according to Richmond County Sheriff Ronnie Strength.

"We are now very confident they had no idea that was Judge Overstreet," Strength said.

William Omar Jacobs, 22, surrendered to police Saturday morning after a team of investigators questioned Jacobs' friends, family and associates on his whereabouts.

"We were picking up his associates, identifying who he ran with, picking up his girlfriend and, of course, through the leads we had developed, hitting all the places," Strength said. "There was just too much pressure on him out there."

Jacobs was booked into the Richmond County jail and charged with one count of burglary. Deputies recovered Overstreet's stolen laptop computer in a garbage can on Starnes Street.

Jacobs fled Overstreet's home early Friday morning after the judge shot and killed John E. Howard Jr., 20, during the burglary.

Overstreet awoke to voices in his home, grabbed his gun and saw Howard coming down his staircase with a bandana on his face and socks on his hands, Strength said. Overstreet shot Howard once in the chest.

Charles - The Judge's secretary WAS NOT Howard's mother. She is the mother of one of Howard's victims in a previous burglary.

Since even liberals don't think this is a thought police crime, the first sentence of this article is irrelevant. B&E is a capital offense, especially at night, when you enter the home of a gun owner (that believes in gun control).

Now maybe Overstreet will

Now maybe Overstreet will hand out stiffer sentences. When Mr. Rex got robbed they thugs got a lite sentence by Overstreet. Time served and 5 years probation. How about it Mr. Overstreet? Will you start giving these thugs the sentence they deserve or will you still allow our streets to be over run with thugs who know they will get out jail fast if caught?

I have read all of the articles about this burglary/shooting and am still confused. Does Howard's mother work as Overstreet's secretary? If so, maybe it was mentioned to Howard by his mother that Overstreet would be out of town and they decided to burglarize the house? Does anyone know or understand the facts???

This is confusing. Georgia law gives one the right to shoot an intruder if one feels threatened or that the intruder has a weapon pointed at one but if this guy had socks on his hands to prevent leaving fingerprints how as he holding a gun or a knife? I missed something evidently since the judge killed one how did they know who number two was?

It is time to lock them up

It is time to lock them up for LONG sentences. Build a tent city adjacent to Phinizy swamp to relieve jails overcrowded
with simple drug users and they can benifit from the same conditions as our fighting men and women, eat the same rations, march, exercise rigorously, and salute the American flag every morning before work detail. That will make them real men to serve as inspiration for the other wannabee thugs after they serve 20yrs. in the h***swamp

Official Code of Georgia Annotated § 16-3-23. Use of force in defense of habitation

A person is justified in threatening or using force against another when and to the extent that he or she reasonably believes that such threat or force is necessary to prevent or terminate such other's unlawful entry into or attack upon a habitation; however, such person is justified in the use of force which is intended or likely to cause death or great bodily harm only if:

(1) The entry is made or attempted in a violent and tumultuous manner and he or she reasonably believes that the entry is attempted or made for the purpose of assaulting or offering personal violence to any person dwelling or being therein and that such force is necessary to prevent the assault or offer of personal violence;

(2) That force is used against another person who is not a member of the family or household and who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence and the person using such force knew or had reason to believe that an unlawful and forcible entry occurred; or

(3) The person using such force reasonably believes that the entry is made or attempted for the purpose of committing a felony therein and that such force is necessary to prevent the commission of the felony.

A person who uses threats or force in accordance with Code Section 16-3-21, relating to the use of force in defense of self or others, Code Section 16-3-23, relating to the use of force in defense of a habitation, or Code Section 16-3-24, relating to the use of force in defense of property other than a habitation, has no duty to retreat and has the right to stand his or her ground and use force as provided in said Code sections, including deadly force.

Charles Wilburn, shame on you! Your comment is both distasteful and reeks of false premises. Judge Overstreet lost his beloved wife to cancer and has been mourning her loss. He was a most devoted husband, and the good Judge would never involve himself with such as you describe.

Who cares about the "mundane"

Who cares about the "mundane" details. Judge Overstreet was forced to protect himself, on his Private Property. Can you imagine what this has done to him and his family. On April 30th of this year, I found a snake in my home. I can't wake up in the middle of the night now without using a flashlight. I constantly look for more snakes IN MY HOME. Not a good feeling. Compound that as many times as you might and you can get a sense of what the Judge is going through and will, no doubt, experience for quite some time.

Count me among those who was confused about Howard's mother being the Judge's secretary. The way it was described in the article was confusing if not read carefully. Overburdened_taxpayer was gracious in setting me straight. I still believe it a remarkable coincidence that Overstreet's secretary is both the mother of one of Howard's victims and the secretary of another. The odds against it must surely be astronomical, but it is surely possible.

Okay...seriously "society"... No Really...celebrating someones death even in crime very uneducated. Dont take me the wrong way because if someone broke into my home with my family in it I would shoot to kill. However, to celebrate the death of someone then wish the other perpetrator was killed also is beyond me. This person has a family and so do all of you and if you think that this type of behavior is okay then I hope you are never on the other side of the fence...
