Judge denies motion to prohibit media at trial

A judge denied a motion Wednesday to prohibit public and media access to an upcoming pretrial hearing for a Columbia County woman who is accused, along with her son, in the March beating death of her next-door neighbor.

Defense attorneys for Rebecca Bowers Sears, 41, and Sean Christopher Bowers, 20, requested that a Jackson-Denno hearing be closed, claiming information presented would be prejudicial to potential jurors.

In the Jackson-Denno hearing, a judge will determine if statements by Mrs. Sears were made voluntarily and if they should be suppressed as evidence in her trial.

Sears, of the 200 block of Hot Springs Drive, and Bowers, of the 4000 block of Briarwood Drive, are charged in the death of Sears' next-door neighbor, Laverne "Kay" Parsons.

On March 25, Parsons was found in her garage beaten to death with a bat and a claw hammer. Sears and Bowers were arrested a few days later. Both were indicted on murder, armed robbery and burglary charges in April.

Jacque Hawk, Bowers' attorney, requested the closing to reduce pre-trial publicity.

He claimed information in Sears' statements is false or misleading regarding Bowers.

"This (hearing) would taint the rest of the proceedings against him to such he cannot have a fair trial," Hawk said.

The information could lead to a need to change the venue of the trial to outside the county and possibly a retrial of the case, Hawk said.

District Attorney Ashley Wright said in her 14 years in the Augusta Judicial Circuit, only one trial required a change of venue and not due to pre-trial publicity, but because the defendant was well-known in a small community.

She said the request is premature because the decision to change the trial venue is one made during jury selection.

"We believe we can get a fair and impartial jury," Wright said.

A date for the hearing has not been set.

By law, Sears and Bowers will be tried separately because the district attorney plans to seek the death penalty.

It's the defense attorney's

It's the defense attorney's job to make as many delaying requests of the court as possible and to work the press whenever it will help the client. The crime was committed in the area and the trial should be held in the area.

I'll bet Sears did some

I'll bet Sears did some serious angry "woman's scorn" on Bowers character. Words spoken in angry are often damning and cannot be "unspoken". Let's hope this doesn't turn in to another Tom Chumbly trial.

It is the lawyer's job to lie, cheat and steal in order to prevent a "guilty verdict" for his client. The more money you have, the more he can do.

What a brutal, senseless murder. If you dont like your neighbor, build a fence, move, whatever. Death penalty?Why? So you can execute them 20 years from now?

deekster, i agree...your discription is my definition of a "scumbag" lawyer..lets see they plead not guilty because......1) they didn't do it, it was someone else, 2) the longer the trial lasts the more pain, suffering and hurt the family of the victim will have to endure-but more importantly...THE MORE MONEY THE HAWK BROTHERS MAKE!!!!!!. as long as they can make money they care little about "TRUE JUSTICE". they are probably well aware of their client guilt based on "discovery" but will "fight on, and fight the good fight" ....those with "NO CONSCIOUS" sleep very well

Scum who savagely murder someone the way Parsons was killed may deserve their day in court, but they don't deserve to have the deck stacked in their favor. If Sears ran her mouth and hurt either case, that's just too flippin' bad for her and her son.

Where does Hawk find his

Where does Hawk find his clients? What kind of track record does he (& his brother) have? Here lately they've lost a few high profile cases. How many of the five involved in the 08 home invasion/murder in Grovetown did they defend & lose? They might want to be a little more selective in their choices of clients (as in the "less guilty" ones). Or, the ones with more money. The Hawk's don't play the media to go for a mistrial? Yeah, right. deek, I'm not familiar with the tom chumbly trial.

My aunt Kay did not asked to

My aunt Kay did not asked to be brutally beaten to death in her own home with a baseball bat and a claw hammer; and she didn't asked to be taken away from her son, husband and her family back in pennsylvania; who love her and miss her on a daily basis and now all we have left of her are our memories of her!! They need to pay for what those two did and they need to get the death penalty ! Beat them like they beat my aunt to death with a baseball bat and a claw hammer !!!!!!
