Car wrecks as driver flees, killing 2-year-old

A 33-year-old father has been arrested and charged with vehicular homicide after authorities say he wrecked a car while fleeing police near Louisville, causing the death of his 2-year-old daughter and injuring his 3-year-old son.

The incident occurred about 8:30 p.m. Friday after an attempted traffic stop, according to a release e-mailed Sunday by the Jefferson County Sheriff's Office.

Other charges against Miller Lee Smith Jr. include serious injury by vehicle, hit and run/failure to render aid, reckless driving, obstruction of an officer, DUI/Child Endangerment, fleeing and attempting to elude, and driving while unlicensed.

A Jefferson County sheriff's deputy noticed Mr. Smith driving erratically and attempted a traffic stop, but Mr. Smith sped away, the report says.

Police found the vehicle overturned in woods about five miles outside Louisville on Middleground Road. An adult male passenger was beside the vehicle and told authorities Mr. Smith had run from the scene and that two children had been in the vehicle.

Deputies found a 2-year-old girl on the ground beside the vehicle and a 3-year-old boy on the ground about 40 feet from the vehicle. Deputies administered first aid until EMS workers arrived, but the 2-year-old, identified as Alike Smith, died at the scene, the release states.

The 3-year-old, XaVion Smith, was airlifted to Medical College of Georgia Hospital, where he was in fair condition Sunday night, a hospital spokeswoman said. Jefferson County sheriff's Lt. Robert A. Chalker said the boy had broken bones and possibly a concussion.

Mr. Smith was arrested after a brief struggle in a wooded area less than a mile from the scene about 11:30 p.m. Friday, authorities say.

"The deputies chasing him did not know there were any kids in the vehicle until after it wrecked. Needless to say, they were really shook up by what they saw," Lt. Chalker said.

Mr. Smith and the adult passenger were treated at Jefferson Hospital in Louisville. The passenger was released and not charged.

Mr. Smith is being held in the Jefferson County Jail awaiting a bond hearing. He also is being held for the Richmond County Sheriff's Office on an outstanding warrant. Richmond County investigators said Sunday that he faced a bench warrant from not showing up for court in 2008, but they weren't sure what he had been charged with. Lt. Chalker said Mr. Smith had a Louisville address on file, but that he told them he lives in Augusta.

What was the initial contact based on? These police chase are resulting in deaths of our children and legal action against that department would be in order. Racial Profiling is a crime against people of color and considered lazy police work because it does not reduce criminal acts. A complete review of that department's policy is required and a federal (outside) agency should produce the report...and where is that in-dash camera from the chase?

I can't believe how you are spinning this Justus. Black, White, Green, or Purple it doesn't matter-if you run from the police you usually have something to hide. Are you saying driving under the influence is a crime only if you get caught? Even if he did not get pulled over, it is still a crime.

The "erratically driving" mentioned in the article is suspect and requires verification. This is a common observation, that some officers use, to gain entry into a citizens' vehicle. The problem is that only particular individuals are effected by this bad practice, not to mention Fourth Amendment violation. So, such an observation causes a chase and the ultimate death of a small child. Was it worth it? ..and the First Amendment applies to Truth Tellers too, and not just printing operations.

Believe it or not, I do have some sympathy for the father. One stupid incident killed his daughter and changed his life forever. In addition to the guilt, he going to spend a big chunk of his life in prison.

???not one of you has noted that the children were thrown 30-40 feet from the vehicle???? Even if the police used any small bit of poor judgement here, those children were obviously NOT secured in a carseat or booster. This dad was pathetic from the start.

robbie, the number of times I've endangered my children is "0". Zero. Never. Not even once. It didn't take much effort at all. With children comes responsibility. No smoking herb, no drinking, no crazy driving and CERTAINLY no combination of the above. Having kids put a dent in my social life, but it was NEVER any trouble not endangering them.

Robbie, we've all made stupid decisions, except it isn't acceptable for someone to make a decision that would put their children in danger. Just yesterday after church, my wife and I were taking our baby out of the car and we were talking about how we cannot understand how a mother can just forget that she left her newborn in the car for hours.

I originally said to just kill him now, but after thinking more about it, I'm not sure what to do with him. I don't want to support his worthless azz the rest of his life, since he will not benefit society. But, somehow he has to support his remaining child, because his wife/girlfriend did not tell what kind of job she had. I hope that the woman now sees what kind of person she laid on her back for, at least twice, truly is - worthless pond scum.
