Recusal request denied for Augusta man facing capital murder trial


A request to remove the judge assigned to preside over the capital murder trial for a Hephzibah man accused of killing his parents and little brother was denied Thursday.

The defense attorneys sought the recusal of Chief Judge J. Carlisle Overstreet in Ryan Jones’ case in Richmond County Superior Court. Overstreet signed the search warrants that the defense intends to challenge. District Attorney Ashley Wright opposed the motion, citing a 2013 Supreme Court decision that found recusal wasn’t necessary in a case where the trial judge previously approved search warrants.

Judge Sheryl B. Jolly denied the motion.

Jones, 27, has pleaded not guilty to all charges filed in the May 21, 2013, slayings of Roosevelt and Edna Jones and 20-year-old Russell Jones.
