Lawyer: Ex-wife of indicted Augusta attorney Joseph Neal Jr. to surrender Thursday



The ex-wife of an Augusta attorney who was indicted Tuesday on rape charges will surrender to sheriff’s investigators Thursday morning, her attorney said.

Pete Theodocion, who is representing Caroline Caldwell Neal, said his client will return from Greenville, S.C., to be booked at the Richmond County Jail.

Neal, 23, who was indicted along with her ex-husband, Joseph Neal Jr., in the alleged sexual assault of an 18-year-old woman, will have a bond hearing Thursday afternoon before Superior Court Judge James Blanchard Jr.

Grand jury arrest warrants on rape and providing alcohol to a person younger than 21 were issued for the Neals on Tuesday after a grand jury returned indictments against the former couple.

Joseph Neal was arrested Tuesday and remains at the jail, held without bond. A bond hearing is set for today before Blanchard.

The two are accused of having “carnal knowledge” of an 18-year-old woman “forcibly and against her will” on Dec. 16 at the Neals’ Kings Way home, according to court documents.

The woman filed a sheriff’s complaint four days later, on Dec. 20, stating that Joseph Neal Jr., 43, had given her four or five alcoholic drinks and marijuana before the alleged assault.

The next day, Caroline Neal was arrested and charged with simple battery related to a fight with her husband. Joseph Neal told the arresting officer that the two were arguing when his wife had accidentally shut his head in a door. The argument escalated to a fight with his wife hitting and scratching him, a sheriff’s report said. All this occurred in the presence of Joseph Neal’s 13-year-old son, the report said.

According to other court documents filed Feb. 22 by Joseph Neal, related to a custody battle over his son, Neal denies the allegations stating that there was “no sexual assault on anyone at anytime.”

The document states that Joseph and Caroline Neal together engaged in a “consensual sexual encounter” with “another adult woman” in their bedroom on the evening of Dec. 16.

Joseph Neal also denies the use of any illegal drugs or the abuse of alcohol in the same document and claims to have submitted to a hair follicle test and 10 urine drug screenings before Feb. 2.

According to the Richmond County Superior Court documents, Joseph and Caroline Neal divorced recently. They had filed twice before, in August and October 2011, which were both voluntarily dismissed. A settlement was reached in the third case filed in January and finalized Feb. 16.
