One man sought for simple battery after gas station incident

A teenager is being sought by police for simple battery after hitting an Augusta man Tuesday at a local gas station.

James Randall Birak, 59, was paying for coffee at the Circle K at 3298 Mike Padgett Highway when the suspect struck him in the back of the head with his fist, according to a report from the Richmond County Sheriff’s Office.

An unknown man then advised Birak not to retaliate because the suspect is on medication, the report said.

Birak stated Circle K employees have video footage of the incident. Deputies stopped by the Circle K to see about the video, but a Circle K employee said the manager had left for the day, according to the report.

The suspect is described as a black male, late teens, 5-foot-8 and 130 pounds. He was last seen wearing a yellow t-shirt, blue jeans and a brown hat.
