Train stop, pot smell send Augusta man to jail

An Augusta man was charged with felony possession of marijuana Tuesday after a nearby deputy smelled the drug while both were stopped for a train.

According to an incident report, a Richmond County sheriff’s deputy had stopped for a passing train at Laney Walker Boulevard about 1:20 p.m. when he said he smelled burnt marijuana coming from a Chevrolet Colorado stopped in front of him.

While waiting for the train, the officer ran the vehicle information, which came back without insurance or registration.

After the train passed, the deputy activated his blue lights to stop the driver, Jamal Leroy Gray, 27, of Royal Street.

The report said the officer observed bits of marijuana in the driver’s lap.

After the deputy was given permission to search the vehicle, he uncovered several bags of marijuana, totaling 34.5 grams, a digital scale and half of a can of Budweiser beer.

Gray was booked into the Richmond County Jail on charges of possession of marijuana, suspended vehicle registration, driving while license suspended or revoked, no insurance coverage and open container.

Hmmm

People are getting bold, bolder, and boldest. I was in dt Athens this past weekend and 3 college aged, upper class citizens, 2 guys and a gal, were sitting in a parking lot of a restaurant just completely fried with windows down in their car and the smell bellowing out. I called my teen daughter and told her about it with a please don't ever be this stupid honey attached. When I hung up she was still laughing.

roll down the windows....

Glad some of the officers have a good sense of smell. Good sense to have around here. Nice weather for the windows to be rolled down, too. Hope they keep doing that while cars don't need their air conditioners on yet. Odds are good they'll catch some more before the summer heat forces more people to close their windows and crank up their air conditioners.

driving under the influence?

Wouldn't a driving while under influence be a charge here too? Driving while stoned. Then again, they were stopped. I have heard that if you are sitting in the drivers seat with keys in ignition you can get charged with DUI, is this true?

Concentration

You bring up an interesting point. With alcohol, the General Assembly, in its wisdom, has established an actual concentration of alcohol in the blood that is illegal for driving — 0.08%.

I don't think they have done that for marijuana. In the case of substances other than alcohol, the police must actually witness some defect in the driving of a person to charge driving under the influence of some substance. Since the guy lawfully stopped for the train, then lawfully stopped for the blue lights, then respectfully co-operated with the search, then did not resist arrest — there is no cause for driving under the influence charge to be piled on.

Trains downtown are great! They are cool to look at and feel the rumble. Also, if you are ever late for anything in this town you can just say "I was held up by a train" and everyone will just nod and believe you. Good bust, RCSD!

Have a great holiday weekend and watch the train tracks......just kidding folks, don't get bent out of shape. @hmb413, I do believe you can be charged even though you are stopped but the article does not mention DUI only an open container and the other things as well.
