A judge said after a hearing today that he will decide whether to reconsider the sentence of a former Augusta gynecologist convicted of sexually assaulting a 9-year-old girl.
Superior Court Judge J. Carlisle Overstreet said he would take under advisement a motion to reduce the 20-year sentence of Jerry Jackson Lee II, 50, of Evans.
Lee was convicted in June 2007 of aggravated sexual battery. The state Court of Appeals affirmed that conviction in September. Georgia law gives convicted felons 120 days to seek a reduced sentence following the affirmation of the conviction by the appeals court. Jackson's 20-year sentence is the maximum allowed for his crime.
Judge Overstreet has a reputation of making whatever decision makes the least sense. I'm always curious what he'll do next and how he remains unimpeached.
Reconsider? Sure, it should be FORTY years plus 10 for every year of the victim.
O k people make mistakes in life and, sometimes you need a second chance in but, sexually battery on a 9 yr old girl you deserve the max.
This is what happens when folks guilty of sexual crimes get lighter sentences: http://newstimes.augusta.com/stories/2008/07/06/opi_464472.shtml
Hopefully, the judge will remember why he gave the sentence in the first place. Great find qunnerhall123.
Maybe we should start drug testing for judges. Unless there is another reason for the ridiculously light sentences they are handing out I would suspect some of them have been playing in the medicine cabinet.
If you file a silly motion like this, the penalty for losing should be to double your prior sentence. And have a very large cellmate who has a child the same age.
Dixieman, excellent suggestions! I certainly hope J. Carlisle doesn't have a J. Carlisle moment on this one.....
Dr. Jerry Lee is one of the most dangerous and destructive individuals this area has EVER seen. He has carefully crafted a way to dodge his financial responsibility to his own children, and he has a cadre of his older relatives who try to clean up after him, the way you would a sick dog. Overstreet needs to not only REJECT this request, but pick up a copy of the paper and read about what Lee's horrific legacy has created that CONTINUES to threaten innocent life. God bless the woman he tortured for years, and may God help repair the damage he did to his own flesh and blood.
The only reduction this man needs is a reduction of his life. Any 50 year old man who takes liberties with a child young enough to be his granddaughter does not deserve to have another chance. He should not have to languish in our prison system, instead let him decay properly in a space that will not require much upkeep other than keeping the grass cut.
This so called "man" is a sociopath and should never be allowed out.
Judge Overstreet should give him a lighter sentence, let him out and turn this MONSTER over to this little girl father, and let him have his way and give him no jail time and no sentencing.
What is amazing is the jury convicted him of sexual battery, but found him innocent of three counts of child molestation. I would have thought that sexual battery was child molestation. I also thought we had mandatory sentences for child predators period. Obviously this is a prime example of how we have two judicial systems, one for the stakeholders and one for everyone else.
Austin is 100 percent correct: The Teflon Doc is getting off easy already by having only a 20-year sentence. By all accounts, he should have been in prison long ago for beating the hell out of his wife, terrorizing their children and abusing prescription drugs. The term "under the jail" is overused, but if it applies to anyone, it's Jerry Lee.
The offender is allegedly a physician who specializes in the care of female disorders--and he chose to molest a 9 year old child. If this were a case where a 19 year old and a 17 year old girlfriend participated in a Romeo and Juliet romance, then a sentence reconsideration would certainly be appropriate. However, this is a 50 year old educated adult and he deserves the maximum sentence--too bad his sentence wasn't 50 years.
