Judge rules against city in lawsuit

A judge has ruled in favor of a former Augusta administrative assistant who sued the city alleging its general counsel violated the Family and Medical Leave Act.

Meschery Powell won a $3,000 judgment against the city, although Richmond County Civil Court Chief Judge William D. Jennings III ruled Ms. Powell wasn’t entitled to any judgment against general counsel Chiquita Johnson as an individual.

Ms. Powell contended Ms. Johnson violated the Family and Medical Leave Act when Ms. Johnson fired her in April 2008. Ms. Powell was given another job in city government, but it paid less than what she made in the city’s law department. Her lawsuit sought to recover the difference in pay and for punitive and other damages she contended amounted to $13,555.
